    good morning all
just had a thought, (after reading a foram on credit charges refunding), will my creditors take the ppi refund money (if i get any)back? because i still owe them them lots of money (IVA)?????
if so then is it pointless putting in a claim????

Hello Pammie, as far as I know if there is any arrears on the account then any PPI refund may be used to pay this off, but it is not pointless to make a claim as I would think the debt is still being paid off.
Take this one step at a time, write all your letters, keep copies, send recorded and keep in touch with us and tell us of any replies. Goodluck.

Credit card charges are usually paid back to the account ,unless the card is already paid off.

    thank you, for quick reply,
with IVA you pay the company aswell as the debit. my iva is finished in, i think,2012. should i wait till then and have MY money, or do it now and give it back to them!!!

If you wait you may be out of time to claim, but I am not an expert on that.

    Hi Pammie

    I agree with Pinknico

I would still try to reclaim now, in case of time limits.;)

I don't know much about IVA, but if there is an arrangement put in place I take it - it stays like that, then you can opt to offer more to towards the debt to being it down quicker, but again I am not too certain on this, its well worth asking on this matter on the other thread DFW or the BR thread, where others have possibly gone through the same thing.;)

I wouldn't have thought you would have to give any of your PPI refund to the IVA company? I thought you paid them a fee every month (with my mum is was £50) and that was it and any money you get back will probably be put towards the debt by the company the loan/credit card is with, which just means the debt is paid off quicker? .....but I'm not sure of this so don't hold me to it!

If they have stated their decision is final a 2nd letter to them is pointless and won't make them change their stance, but what it does give you leave to do is take your complaint to the Financial Ombudsman Service telling them everything you've put down on here - if your husband was unable to claim on the insurance due to his hours being below 16 then how can it be anything other than mis sold !!!

Hi, thanks to everyone who replied to my original query. I have been in contact with the FOS and they are taking up our complaint as they say we have been unfairly treated in that the loan was sold on the understanding we have insurance otherwise the loan would not have been granted!, even though the ppi is useless to my husband. I have managed to find out all loan details and they are as follows:

All loans had a lump sum PPI added to the loan plus monthly payments!

    1. Loan amount £5000.00 (1997) x 36 months PPI £329.40 then £10.56 pm
    2. Loan amount £6000.00 (2001) x 60 months PPI £493.36 then £11.22 pm
    3. Loan amount £3000.00 (2005) x 36 months PPI £268.52 then £9.31 pm
    4. Loan amount £8600.00 (2006) x 60 months PPI £720.90 unsure of the PPI amounts per month on this one.

If anyone can help with a rough estimate of what we would get back, if successfull I would really appreciate it, I have looked at how to calculate and I keep coming up with slight variations!!! Once again, any help would be greatly received.
