    Hi,
    I've just started to reclaim my PPI charges on a loan I took out with the last six years with HSBC.
    I wrote to them to ask for the copy of loan agreement (using the template letter) and they have written back to me to say the can't locate the documents and that they were issued to me at the time the loan was agreed. Instead they sent me a series of bank statements showing the loan payments.

    Has anyone else had a similar experience? I'm not sure what to do next should I write to HSBC again or take it to the Information Commisioner (they replied to me just within the 40 days) If anyone one has taken this to the information Commisioner do they have a template letter?

    Hi there

    If you live in England and Wales and taken this out the last 6 years, they should be able to retreive your information.

    You could contact the ICO and explain, tell them this is the response you had and you want some advice, or ask if they can help you, good luck.
    I would ring the ICO though and not email, as it may be some tiime otherwise before you hear, so due to the bank holiday if you can ring them Tuesday.

    However, you can still continue to reclaim the PPI.;)

    Forgot to ask in my above post, did you send them the £10 payment for this SAR request as well?

    If they did not supply what they should have had and only the statements, I would ask them also to return your money back to you.;)

    Hi, thanks for the quick response, that's really helpful I'll give them a call on Tuesday. Also regarding the cheque I think I only sent one for a £1, but I'll mention it in my next letter.

    Hi again

    For just the agreement its just that of a £1 requested, but for a full SAR its that of £10 payable by either postal order or cheque payment.;)

    in the template letters should i mention about the IVA, they should notice it anyway, but just incase?

    HE TOLD ME 3 WAYS TO HAVE GOOD LUCK!!!!!!:j

    no i haven't claimed anything yet, spoke to G.E MONEY (secured loan in 2002/2003), they said something about account all paid or used up, so can't claim anything back, they sent me a copy of my agreement papers and on it i have signed and ticked the box stating i wont the ppi. i can't remember the conversation with them about ppi (requesting it or not). what do you think?


    sorry when i re-read this it confused me aswell.
    so
    if the ppi was for 5 years and the 5 years have finished,then i wouldn't be able to claim the ppi back.
    i think thats what they ment ?????????

    When Melorablack mentioned about this, I had also read back on the post we did think or thought that what GE are saying is that you were trying to make a claim, for example sickness or unemployment, but because you have completed this loan, there would be no need to claim, we think GE must have got confused not realising that you want to reclaim on the PPI for mis selling.

    Does that make any sense?

    You have paid this off haven't you, its settled?

    So in this case if mis sold you can reclaim on the PPI.
    Although it would not matter if this was not settled, you can reclaim for mis selling on a policy anytime, active or settled.

    That is what we thought. lol;)

    hi di,
    i have had a good think about ppi claiming, with the credit cards i think i applyed on line, so poss ticked the box stating i wont it.
    but still have charges to claim back, but have no statments, i think i'm looking at about £80/100 in sar letters!!!!!!!
    hoefully will have more money to come back.
