Hi all,
I have noticed that multiple Claims Companies who are charging for the PPI claims service are holding funds.
Say that a client has 3 accounts under claim. The barclays account sends a cheque for £X the HSBC reduces the Balance by £Y and the Natwest account is still underclaim.
As the cheque was recieved by the claims company. They hold the funds to pay for the Fees on both the Cheque AND the balance reduction. The remaining difference is still held until the completion of the other claim has completed.
When the client calls the claims company requesting that the funds are refunded to the client. The claims company is reluctant to give the money until all claims completed or just refuses the money is refunded until completion.
Can a company hold Funds from one claim to pay for another?
What are your thoughts

well ..... depends what you signed up for. Claims companies are leeches preying on people. The FSA hate them, most are thieves and rogues ...... so to everyone

have in the last week or so received a letter from Citi that states they are upholding my complaint and going to pay £486, whoop whoop. Then included in the letter they say the future mortgage claim I had with them will also be dealt with very soon. Monday had a letter from citi saying complaint for future mortgages up held and a total of 3,254.49 to be paid. 7 to 10 days for cheques HAPPY DAYS.....I thought it would only be about £500, just a little excited.....
Took one letter for each and twelve weeks:beer:

I have told everyone I know, loads that work with me (all civil servants) have initially said they haven't got any PPI, when I have said check, one guy came back and said he discovered 13 accounts up to 20 years old with it on, so his claims have gone in.
It must be said tho, it is all down to the help and support you guys give xxIF HIND SIGHT WAS FORESIGHT WOULD I STILL NEED TO GO TO THE OPTICIANS???0 -

Been reading these threads over the last few weeks and finding them very helpful. I have had a nightmare experience with Cahoot going on since last May (2011) and thought I would share it here, I am hopeful that good will still come of the situation for me based on some of the wonderful success stories on here.
Thank you to all who post the very useful info and guidance on here, it is so valuable.
Anyway, I had a flexible loan and a credit card with Cahoot, both taken out in 2001. I was aware quite early on that the credit card definitely had PPI on it and my husband told me to cancel it (he works in finance) but I never got round to it for one reason or another. I am quite sure that the loan also had PPI as I remember seeing the line on the online statement each month splitting out the payment.
The loan was paid off in 2006 but then reinstated by me in 2007 to enable me to buy a car - this was one of those accounts where you could keep the 'loan' open with an accessible balance even when it was paid off so to speak. The credit card is still open now although the PPI no longer appears in the payment breakdown - I do not remember cancelling this although I do have an option to cancel the PPI in the account management options.
So, as everything was set up online I had no actual evidence of payments or the full credit agreement, I therefore sent an SAR to Cahoot in May 2011, they did not respond. I re-sent it recorded in July 2011 and they cashed the £10 cheque this time but did not respond. Furious now I wrote again in September chasing it up but....again....nothing. Finally I wrote to an address at Santander in January and also the FOS.
I finally got a response from Santander but it only relates to the second 'stage' of the flexible loan from 2007 onwards when it was reinstated. Says nothing about the original loan or ppw and absolutely nothing about the credit card.
I have now had a letter from FOS stating (rather infuriatingly) that I need to write again and give them another 8 weeks.
So, I did a load more research on here and decided to wing it and have now sent the template letter asking for the PPI back (which I know was there but have nothing to show for) and am hopeful that they will respond at least, to this.
