    Fraud by false representation

    So everyone is clear about this ...

    (1)A person is in breach of this section if he—
    (a)dishonestly makes a false representation, and
    (b)intends, by making the representation—
    (i)to make a gain for himself or another, or
    (ii)to cause loss to another or to expose another to a risk of loss.

    (2)A representation is false if—
    (a)it is untrue or misleading, and
    (b)the person making it knows that it is, or might be, untrue or misleading.
    (3)“Representation” means any representation as to fact or law, including a representation as to the state of mind of—
    (a)the person making the representation, or
    (b)any other person.

    (i)to make a gain for himself or another <<<<<
    "himself is the salesperson and "another" is the bank who employs him"
    Therefore, by the bank paying commission on sales, they implicate themselves in false representation
  • Hi all,

    Sent FOS questionnaires to Lloyds TSB and Citi Financial last Saturday by recorded delivery.

    Citi have responded with a standard letter thanking me for contacting them - they have given me a final response timescale of 8 weeks :T

    Nothing from Lloyds TSB yet.

    Hi guys

    Not sure if this has been covered - searched but there's so much in this thread! Wrote to my bank (Natwest), using the form letter as I didn't have my loan details available. Just had a letter back (minus my cheque for £1) telling me a bit of bumf about the CCA 1974, and the DPA, with a nice little closing line saying that as my loan is not currently active, they have no legal obligation to provide me with my loan agreements.

    So I rang and spoke to the PPI claims line and they told me that you can obtain your documents for no fee (as far as I am aware) from:

    RBS Data Protection Manager
    Regulatory Risk
    Business House B
    2nd Floor
    PO BOX 1000
    Edinburgh
    EH12 1HQ

    Just thought this might save some people £1 and a stamp! Anyone else had this back from them, by the way? (Edit: Found some replies mentioning the same thing - must learn to use the search better!)

    hi they normally acknowledge in about 14 days.

    About time, you wonder why he got the knighthood in the first place certainly not for services to the banking industry.

    Keep chasing this, i don't believe the banks are being truthful in a lot of cases now, LTSB tried to catch me out using the same tactics.

    I too have had quite a few of these responses (as the accounts, both loan accounts and credit card accounts are now settled/closed). Does the above address only apply to NatWest or Royal Bank of Scotland accounts?

    And if I have been fobbed off without the relevant PPI T&C's being provided, what do I need to do to obtain a copy?

    The accounts are Halifax, M&S Money, Barclaycard, Egg and Burton (i.e. Santander).

    Do I need to use the SAR route and pay £10 each?

    You could go down the SAR route but first go to each one and if you can answer NO to the following, you will no doubt win


    *Did YOUR BANK explain the full cost of the PPI when you took out the loan?
    *Did you specifically ask YOUR BANK for PPI?
    *Did YOUR BANK make clear that PPI was optional?
    *Did YOUR BANK ask you about your medical history?
    *Did YOUR BANK ask you about any existing payment cover?
    *Did you know that YOUR BANK added a PPI policy to your loan?
    *Do you think YOUR BANK treated you fairly?
    *Did YOUR BANK ask if you have any existing medical conditions?
    *Did YOUR BANK ask if you were entitled to sick pay from your employer?
    *Did YOUR BANK add the PPI without your permission

    If you answered no to any one of the above you could be owed thousands of pounds
