I'd be more inclined not to speak with them directly as I've always thought in these instances it's best not to speak but to keep things simple and put your case in writing?
Surely, by speaking with them directly, you are more inclined to weaken your case against them by giving too much away aren't you?0 -
After lurking around the forum since late summer I finally decided to go for it and sent off a number of claims today. Mainly due to the wonderful sense of support and community which is here.
I deliberated for some time, wondering whether I had taken the PPI out for the right reasons, was I miss-sold etc, but after reading the support and help via this forum I thought I would go for it.
One claim is with HSBC for a front loaded PPI which I *think* only offers PPI for five years, despite it being a seven year loan. ALso have paper work which says I advised I had sickness cover, and other boxes which state 'no/don't know' to wanting to use this for my loan. I had 6 months full pay/six months half pay and a reasonable redundancy package.
A similar front loaded PPI with MBNA which doesn;t give details on how it was broken down, and also an MBNA credit card taken out over the phone. The same employment situation exisited at that tiime.
I have no idea if I was miss-sold; reading stories on here I think I may have been so I will just wait and see.
I just wanted to say a big thank you to everyone who has shared their stories on here, along with the tirelelss help and support offered. I will keep you posted but you have potentially inspired so many people to look into this.0 -
I just had success with my old Egg Loan.. (and it only cost me the price of one stamp..... £353.50 refund heading my way).
This has spurred me on to chase after my CitiFinancial PPI now... had them both at the same time asnd was sold PPI even though I was only and Agency worker!0 -
If you have not already, make your case and if they delay, threaten them with a County Court Summons.
You can but remember that the success rate in a court is considerably less than at FOS, you need to calculate how much you are claiming and you will probably find Barclays, as the respondent, is entitled to choose a court convenient to it - which you will then have to travel to, probably at your expense, win or lose.
You will also have to pay the court fees up front and only get them back if you win.Trouble is that Bob Diamonds JERKS ARE READING FROM A SCRIPT
I think that statement contravenes forum guidelines.the reason Barclays are inundated with complaints is they sold fraudulent policies called PPI or in your case OD Protection
PPI is NOT inherently wrong. It can be missold. They are undoubtedly inundated with complaints - but ironically it is a lot of those complaints that are fraudulent. As an example, I was talking to a broker yesterday who has received a complaint about the sale of a PPI policy which never existed.which probably would not have paid out anyway.
That is the nature of insurance - the burdens of the few are carried by the many. If it was more likely than not that a claim would be made then the risk would be uninsurable - so that is not grounds for complaint.Go through your policy carefully and decide if it was fit for your purpose. If not, you can claim it all back
No you can't - you can only complain if it was missold. The mere fact that it will not do what you wanted - or that you have decided, with hindsight, that you did not need it does not mean you are entitled to your money back.and the great thing is, you can sue Barclays under the Fraud Act.
No you can't. A person can be prosecuted under the Fraud Act and I suppose you could attempt a private prosecution but you would have to prove it beyond all reasonable doubt.
You could also not rely on it for a sale prior to 2007 because the Fraud Act only came into force in that year.
However, as far as I am aware, the extension for new PPI complaints has expired so you can go to FOS after 8 weeks, I think.0 -

Hi,
I had a loan with HSBC which I paid off a few years ago and I am trying to find out whether PPI was included. I no longer have the paper work and so I sent a letter to HSBC based on the 'Policy terms and conditions' template on the MSE website. HSBC sent back a copy of the generic terms and conditions for the loan but this does not have any details specific to my agreement. Am missing something here? How does the terms and conditions which would have been sent to everyone taking out a HSBC loan help with reclaiming for missold PPI? Can somebody here please clarify?

If you did it over the phone,just stick to reasons for mis sell,they only take your details and reasons for mis sell,they should not quiz you,you will recieve a letter with their findings after they have looked at the complaint,somebody will verify this i am sure,if you feel you dont want to ring,then just send the letter.0 -
Hi musky sounds like a misell and yes technically you can claim that far back how easy it will be will depend on the bank "finding" your records, good luck with this and you know where we are if you need help.:)
Hi is there a standard letter to send on the first instance I can only find letters requesting paper and the questionnaire am I being blind. Just want to make sure I include all the relevant information and use the correct wording. ThanksClaire0
