Morning, Thanks again for this, I'll send off the Questionnaire this week and hope for a miracle!

Is there any more draft letters on PPI reclaim apart from the Credit Agreement request?

    Hi,

I had a loan with HSBC which I paid off a few years ago and I am trying to find out whether PPI was included. I no longer have the paper work and so I sent a letter to HSBC based on the 'Policy terms and conditions' template on the MSE website. HSBC sent back a copy of the generic terms and conditions for the loan but this does not have any details specific to my agreement. Am missing something here? How does the terms and conditions which would have been sent to everyone taking out a HSBC loan help with reclaiming for missold PPI? Can somebody here please clarify?

    Thank you

    Martin[/QUOTe

Hi martin this is just another delaying tactic, you could send a sar if you have multiple accounts with them but for a paid up loan i'd be inclined to call into your local branch as it's harder for them to turn you away when your standing in front of them a sar would be a last resort.

Hi bb you could just ask them in branch and see what they say, as i've said on here it's harder for them to turn you away if your standing in front of them.

Further misunderstanding on your part Beamerguy.

    FOS cannot fine firms.

Hi, your various points are interesting. With regards to the above, the FOS are increasing their charges be it a fine or a penalty and indeed the FSA have the power to fine. No different to the FOS going to the FSA regarding the huge complaints that resulted in the court case

    COUNTY COURT SUMMONS.
This was said in the context that if a payment was promised and despite that no payment was received, County Court action was an option. Especially as the FOS are now taking longer and longer and as you can see, people want money paid back.
Yes of course, it is possible for a bank to request the case would be heard in their area but, it can still be heard in your area by claiming hardship and that hardship would be result of non payment. Yes there is a small fee to issue a summons, but just like the bank charges, it would be very doubtful that the bank would attend anyway especially as they promised payment and did not deliver

The point here is giving and showing everyone who is struggling to get paid, another option to the FOS which as you already know can now take 12 months or more. Options should be clearly shown to people

I assume you read the article whereby he said " he wanted to get rid of his Jerks" ?? ... his words not mine

PPI is NOT inherently wrong. It can be missold
We all agree that if an insurance does what it says on the label, it is fine but its not a case of "it can be misold" --- IT WAS MISOLD countless thousands of times hence the FOS are bogged down to a degree that it will take many months to sort out, if ever
Like everything in life, there will always be people who will try to claim on something they never had, there is little point in this but they will be in the minority, we are talking here of the majority who have been misold by the banking/insurance industry

"which probably would not have paid out anyway."
We are all aware that insurance works on a "number game" but this is large scale fraud where policies were so designed never to pay out for the majority .... therefore as you say, none of these poor people would be insurable

"No you can't - you can only complain if it was missold"
As the majority, 10's of thousands were misold. It is not a case as you say "it will not do what you wanted" ... it is the banks who TOLD us what it would do and they lied hence all the claims

With regard to fraud against the banks, this is a space to carefully watch

I think if you have any further comments, best to PM me as we do not want negative information being given out wrongly when there are so many people here who are desperate to get money back
  • Am I getting confused between PPI and MPI - can you make a claims about being mis-sold MPI which is what I think I was told I had to take out with two mortgages to take the applications further and not PPI.

Can I take this further and if so do I follow the same route as the PPI mis selling guide?

    Thanks

Hi musky the only difference is one is loan protection ppi, mpi is mortgage protection i believe there is a thread on here somewhere specifically dealing with mpi
  • Hello just recieved my letter from barclaycard regarding my 2 accounts one barclaycard on egg card. Apparently there was PPI on the baclaycard that I was unaware about so they have told me they have opened up a complaint regarding this issue, but they also say in the letter that they have no record of my egg crdit card account so I was wondering what my next move should be in relation to my egg card. :)

    Thanks for the replies!
I've just sent off my completed questionnaire to Santander to complain about A&L so i'll await their reply! Roughly how long does it take for them to acknowledge the complaint? Do they keep you hanging on for weeks or are they normally pretty sharp about it?
