    Asked them why my son had heard about his OD protection last week when he complained a week after me and was told "it doesnt work like that"

    Hi, look .... dont take any rubbish from Barclays. If you have not already, make your case and if they delay, threaten them with a County Court Summons. Trouble is that Bob Diamonds JERKS ARE READING FROM A SCRIPT and the reason Barclays are inundated with complaints is they sold fraudulent policies called PPI or in your case OD Protection, which probably would not have paid out anyway. Go through your policy carefully and decide if it was fit for your purpose. If not, you can claim it all back and the great thing is, you can sue Barclays under the Fraud Act.

    I know Barclays have been churning out some disingenuous reasons for not upholding complaints recently and was quite prepared how to respond if they tried that with me.
    However I am not sure how to go about challenging the excuse of “we have informed the FSA and FOS" and not getting any response to my complaint! Checked website and it still states 8 week time limit.

    They sent me a letter apologising for delay a couple of weeks ago and told me to go to the FOS if I wanted.

    I have good reasons for mis sale (they upheld my complaint for mis sale of ppi on 2 loans last October and paid the redress quickly)and I have sent them a very detailed FOS questionnaire.Barclays Dublin have told me my PPI goes back to 1994 and I have the policy number. I cancelled the policy in November.

    I think they have a quick look and if it doesn't appeal, they choose another to investigate.
    Any advice on how to move this forward appreciated. ;)

    You think that's bad, we were told our case would take 12 weeks as per the FSA ruling, we have now been waiting for 23 weeks with no response from Barclays, despite all our weekly phone calls and letters...:mad:

    Hi murrie barclays have totally lost the plot now, my case began last november 2010 when i submitted a complaint, i then had a rejection letter back saying basically i had ppi and i paid it i could have cancelled it whenever i wanted usual blah de dah, i took it to the fos and in october of last year i had a letter from the fos saying that although barclays weren't admitting liability they would make me an offer of goodwill that was as i say back in october after receiving no offer or no cheque by the middle of dec i contacted the so called ceo's office only to receive a letter after 2 weeks to say i did have ppi but it was never activated and i never paid it so i've put it back into the fos as you can imagine what i think about them is unprintable, it's back at the fos again now.

    Tell him you are disgusted by the organisation he runs, its fraudulent and they stole money from you. STATE, you will issue a County Court summons against them if they do not resolve your problem with 7 days.

    YOU MUST PUT FULL PRESSURE ON THEM NOW

    This is how this loan works i am afraid.

    Write to FP and put this.
    We/I believe we were mis sold the ppi on the above account number,and would like recordings,if any to the contrary of my/our reasons for mis sell set out below.

    1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.

    2) We/I were told that the ppi was a 5 year policy, but not told the ppi would still be on the loan to term end with interest.

    3) We/I were told that if we did not make a claim,or go into arrears on the ppi ,after 5 years we would recive the cashback of ppi but this would not include the interest made on these payments that we paid over the 5 years.

    In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included. This will entail:
    A refund of the monthly payments that have actually been paid towards the overall loan in excess of those that would have been needed, if the original loan had been sold without the PPI policy.

    In addition, interest at the rate of 8% simple per annum to any excess payments made from the time each payment was made to the point that Firstplus pays them back to us. We/i believe we were not given enough information on this ppi to make an informed decision. Had we/i known the full cost of this ppi we would not have taken it.

    Unless you can prove without doubt that this PPI policy was fair, reasonable and suitable for my/our circumstances we/I will require you to rearrange the loan as if PPI had never been included on the above loan.

    You were mis sold this and this is a win,you will get the total ppi taken off your loan and your monthly payment will reduce by the ppi monthly amount,this will save you thousands in interest over the remaining term,you will also get some cash back to you.

    As you have had the ppi back,they will give you 3 options with this mis sell,you need to take the one that resets the loan without ppi,otherwise,you will still be paying this ppi back with interest.

    You ask for the copy of the recording,as you want to hear this being "sold" to you,as you did not tick the box on the internet application and did not want ppi,why would you have taken it during a telephone call,unless you were "sold" it.
