Hfc bank, still waiting for my pay out day 33 now - they said they paid via bank transfer on Thursday 8th dec, but still nothing - I thought bank transfers were instant now or at most 3 days (I.e bacs)

Anyone know of a transfer method longer than bacs into Natwest Acc

Good morning

I sent the following to Nat West a few weeks ago

I am writing to request a copy of the credit agreement for the above account under sections 77−79 of the Consumer Credit Act 1974. I enclose payment for £1. I would also like to request a copy of the terms and conditions that were applicable to the above account at the time as I no longer have a copy and would like to check some of the details.

I have also enclosed a £10 payment for a FULL breakdown of my account.
Please note that my address at the time was *******************************.

I look forward to a response within 12 working days.

Yours faithfully,

The response I got was as follows :

Your request for documents contains some misconceptions about your entitlement to information in a specified form and our obligations to supply that information.

As you are aware this account has been fully repaid, and therefore, there is no active agreement between NatWest Creadit Cards and you with regards to the above account.

The Consumer Credit Act is for active agreements and therefore there we are under no obligation to provide you with the requested documents as your obligations to us under the agreement have ended.

I trust the above clarifies matter for you.

Are they right ?

I thought I was still entitled to a full breakdown of my account ?

The strange thing is that they have sent back the cheque for £1 with the letter but not the one for £10.

there right on the point about the cca request wrong about the sar, you are fully entitled to a full and legally executed sar under the data protection act 1998 and they must comply by law, i'd get back to these clowns and tell them that you will report them to the fsa and information commissioners office for a breach of the regulations, they cannot get out of this.

HOW RUDE ARE NATWEST ??? Well they get it from the RBS ?

THEY CANNOT IGNORE A SAR --- PERIOD

Email the CEO Stephen Hester and start by saying

"You seem to be under the misconception that you are above the law. I requested and paid for a SAR and that is what I expect you to provide me by return under the Data Protection Act"

THIS IS THE MAN WHO SHOULD TRAIN HIS STAFF PROPERLY
STEPHEN HESTER CEO Stephen.Hester@rbs.co.uk

Many Thanks
• Well I have posted my reclaim to First Plus today to claim back by £5500 front loaded PPI on a loan that was paid off within a year in 2006....... wish me luck :-)

How long do I have to give them for their response?????
Hoping 2015 will be a better year :)

Send this to FP,this is a win.The interest on the ppi is included in the monthy payment, you will get 8% to the date of redress.

We/I believe we were mis sold the ppi on the above account number, and would like recordings,if any to the contrary of my/our reasons for mis sell set out below.

1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.

2) We/I were told that the ppi was a 5 year policy, but not told the ppi would still be on the loan to term end with interest.

3) We/I were told that if we did not make a claim,or go into arrears on the ppi ,after 5 years we would recive the cashback of ppi but this would not include the interest made on these payments that we paid over the 5 years.

4) We/i believe we were not given enough information on this ppi to make an informed decision. Had we/i known the full cost of this ppi we would not have taken it.

In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included. This will entail:
A refund of the monthly payments that have actually been paid towards the overall loan in excess of those that would have been needed, if the original loan had been sold without the PPI policy.

In addition, interest at the rate of 8% simple per annum to any excess payments made from the time each payment was made to the point that Firstplus pays them back to us.

Unless you can prove without doubt that this PPI policy was fair, reasonable and suitable for my/our circumstances we/I will require you to rearrange the loan as if PPI had never been included on the above loan.

Thanks Amersall,

I have sent my form back today so lets see what happens. When we paid the loan they took the full 5 years worth of premiums!!!!

Lets see how long they take to respond on this, I have a feeling they are going to drag this out. How long do I have to give them to respond?

Again thanks for your help on this and everyone who keeps the forum going, I wouldnt have even known where to start.:T:T:T:T:T:T:T:T:beer:
