  • Hi all,

    I'm new to this so be patient, My Dad asked Clydesdale bank to return his P.P.I payments from his old Credit card and after much time they agreed they owed him over £2500 but as he was in trouble with his card payments they were giving the £2500 to the Debt Collector who is chasing Dad for the debt.
    Can they legally do this?

    Hi bigbear congratulations on your dads success, i think the bank will probably be within there right to do this i don't agree with it though, all you can do is challenge this

    Quick Q I didn't think it was worth starting a new thread for. I'm considering trying to reclaim the PPI I paid on my egg card (now Barclaycard) which I paid for a year or so then cancelled. I've had the card for at least 7 years and there's a balance on it (I use it for balance shifting whenever there's a 0% deal on). What I want to know is if anyone has ever had their card cancelled if they've tried to reclaim?

    I'd be looking for the PPI to clear off this balance.

    Hi momo that is always a possibility(cancelling your card) barclays did this with me and cap 1 froze my card as they assumed that because i'd tried to reclaim i was hard up and could'nt pay my bills as i was claiming misold, this is actually against the fsa's rules though.
  • I sent my questionnaire off to lloyds claiming on 4 closed loans tho I didnt think I had paid it on the last one i had for 12k, had no loan account numbers just stated on the form the amounts of the 4 loans, they wrote back to me saying they cannot take claim any further as the loan acc no I provided had no ppi attached (I quieried 4?!) so I rang the helpline 32 minutes later, they were no help couldnt tell me anything about the other 3 loans but did say the one he had found had no ppi, fair enough I already knew that so has told me to go into my local branch to ask about ppi on the other 3 closed loans, im thinking I may now send a SAR ....! I dont bank with them anymore haven't for years.

    I assume they sold the debt to the debt collectors if they did, they probably sold it for a discount. Clydesdale are not a pleasant bank and most feel they should sink into the dirty River Clyde, it would suit them

    NOW, Insurance policies cannot be transfered so it would be illegal if they transfered this to another party without your permission.

    They would need to pay the money to you and then you sort it out with debt collector. If you are having problems with the debt collector, let me know. As the bank have offered a refund, that means they have admiitted the PPI was misold, in turn, my the admission, they have admiitted to fraud. If the debt collector has purchased the debt, then he has purchased a fraudulent transaction and therefore could be subject to a Claim for damages from you, this could in itself be worth £1000's.     CAPPO is right Barclays run by Bob Diamond IS A SHAMBLES and nobody should deal with this disgusting bank.

    THE FSA have a ruling on this
  • Just found my bank statements out from 1995 to prove that I paid two yorkshire bank loans for Ombudsman and on my statements it says

    MLOAN LPOOL then loan number, anyone got any ideas who this would have been with as I was paying £244.54 per month!!!

    pay no attention to this princess i had exactly the same with them i stuck at it and eventually got them to admit i had 2 loans with ppi on but it was like pulling teeth they told me over and over again i did'nt have ppi, i told them i did, i've now sent my final two credit cards to the fos as i got sick and tired of dealing with them in the end.

    I sent the following to Nat West a few weeks ago

    I am writing to request a copy of the credit agreement for the above account under sections 77−79 of the Consumer Credit Act 1974. I enclose payment for £1. I would also like to request a copy of the terms and conditions that were applicable to the above account at the time as I no longer have a copy and would like to check some of the details.

    I have also enclosed a £10 payment for a FULL breakdown of my account.
    Please note that my address at the time was *******************************.

    I look forward to a response within 12 working days.

    The response I got was as follows :

    Your request for documents contains some misconceptions about your entitlement to information in a specified form and our obligations to supply that information.

    As you are aware this account has been fully repaid, and therefore, there is no active agreement between NatWest Creadit Cards and you with regards to the above account.

    The Consumer Credit Act is for active agreements and therefore there we are under no obligation to provide you with the requested documents as your obligations to us under the agreement have ended.

    I trust the above clarifies matter for you.

    Are they right ?

    I thought I was still entitled to a full breakdown of my account ?

    The strange thing is that they have sent back the cheque for £1 with the letter but not the one for £10.
