    Hi kim as i said to another poster last night i think you'll find that if the debt is sold on and you have a payment arrangement in place any returns will have to be paid over to the finance company, all you can do if you make a recovery is talk to the bank and see if there is any leeway although i would think it would be at there discretion as you are in arrears, good luck

    Hi billy i'd sar them for the info now, all the banks are playing hard to get now i'd give them another chance to sort this or wait for a final response mentioning the ombudsman then fos it.

    I am sending HUGE thanks to ALL of you here who advised and encouraged me, I was very unsure of doing this as I thought it would be long-winded and complicated, but it wasn't - just the one form & sit back and wait.

    Hi,
    Can anyone help.2 loans with Sainsybury's loan one refinancing the other. Put complaint in may and got an uphold letter 27th August, but it seems they have just investigated 1 loan (this loan ran for 4 years, the earlier one 7 months)
    Have just had an arguement with one of their employees as she is stating that they are only obliged to investigate loan that was initially complained about. I argued that these were linked loans and that as part of my offer it said it would investigate all loans I had taken out and under FSA guidelines all loans must be investigated!
    Am I right, or have I just made a fool of myself?
    I am so angry - Has been ongoing since May and they still can't get it right.
    Oh, and I am still waiting for payment, for loan upheld!!

    No irnbru you are perfectly right and correct they have to investigate any and all loans on your account whether you know about them or not, read my post 2 or 3 back we are starting to see the banks go back pre j.r now where they appealed everything and always tried to wriggle out of paying up, as beamer would say hit them hard.

    We/I believe we were mis sold the ppi on the above account number,and would like recordings,if any to the contrary of my/our reasons for mis sell set out below.

    1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.

    2) We/I were told that the ppi was a 5 year policy, but not told the ppi would still be on the loan to term end with interest.

    3) We/I were told that if we did not make a claim,or go into arrears on the ppi ,after 5 years we would recive the cashback of ppi but this would not include the interest made on these payments that we paid over the 5 years.

    4) We/i believe we were not given enough information on this ppi to make an informed decision. Had we/i known the full cost of this ppi we would not have taken it.

    In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included. This will entail:
    A refund of the monthly payments that have actually been paid towards the overall loan in excess of those that would have been needed, if the original loan had been sold without the PPI policy.

    In addition, interest at the rate of 8% simple per annum to any excess payments made from the time each payment was made to the point that Firstplus pays them back to us.

    Unless you can prove without doubt that this PPI policy was fair, reasonable and suitable for my/our circumstances we/I will require you to rearrange the loan as if PPI had never been included on the above loan.

    There is a pertinent sentence in the letter I get from MINT which says - "This money will be automatically credited to your card balance. If however your card is no longer active we will send you a cheque".

    They should now send you a cheque,give them 7 days,if you dont recieve this,give them a ring.

    Thanks Cappo, do you happen to know what guideline it is (so I can quote it in email) and who I complain to - its HBOS, I wouldn't normally single anyone out when complaining but their employee was really really rude and generally unhelpful!
