    Thanks Amersall,

I have sent my form back today so lets see what happens. When we paid the loan they took the full 5 years worth of premiums!!!!

Lets see how long they take to respond on this, I have a feeling they are going to drag this out. How long do I have to give them to respond?

Again thanks for your help on this and everyone who keeps the forum going, I wouldnt have even known where to start.:T:T:T:T:T:T:T:T:beer:
You are very welcome x they have 14 days to reply initially,if you have not heard anything by then, ring them and ask if they are looking into it,good luck.

    Hi all,

First of all apologies if I am posting as a reply incorrectly, couldn't find a button that said 'post a new question'...

I am trying to reclaim PPI back from Santander (nee A&L) for a loan that I took out in Aug 03 and paid off in Jan 06. I know it had PPI, which was sold as a way of securing the loan, but annoyingly, I don't have all the details of the loan (full account number), I only have the details that are on my credit report along with the address I was at when I took out the loan.

After the first letter I sent Santander wrote back and said they couldn't find any details of the loan. I re-sent some details through and included the address I was at when I took the loan out. They wrote back today to say that they no have a record of the loan as they have deleted records 'in line with their retention policy'.

I called the FOS, who agreed that the bank does not need to keep records for agreements older than 6yrs - this seems a bit unfair as the loan still shows on my credit report, and was in force less than 6 years ago.

Can anybody advise of my next step, or do I have to accept that I cannot get this PPI back?

Thankyou in advance for any help you can give at all...

    Danny
If this loan was paid by DD and you have internet banking,go on your DD list and the account number will be there.
If you have a Santander near you, then go into branch, they may find your account number there.
When you have the account number,
look here for reasons for mis sell and if any/all apply to you then put a claim in

  • Hi
Apologies if this has really been asked... We are trying to claim PPI back from Santander - they have accepted the claim as valid, and even verbally given us a figure, which they said would be confirmed in a letter sent 25 Nov. So far that letter hasn't arrived, neither have the copies of the letter they claim to have sent us on 6 Dec and 9 Dec. We're not having problems with any other post. Is this a delaying tactic to avoid a deadline? and if so, what can we do?

    Thanks for your help
  • At present trying to reclaim ppi on debenhams sore card sent claim to santander. Santander have sent reply saying they are turning down claim as the insurance was et up by their telemarketing dept back in june 2002 however they don't have recording of the said telephone call. Well the call never happened as i took the store card out in the store, also it seems that santander state they explained in full the benefits of what they call account cover.Has anyone had same response from santander i presume this is a standard put off where they have done nothing wrong and explained everything in full. Hope someone has managed to be successfully to claim back their ppi claim from santander.

    Hi crawleen,
DO NOT GO NEAR ANY CLAIMS COMPANIES. They will do no more and have no better success rates than what you can do yourself, and if you succeed YOU keep all redress. They will charge you at least 20% + vat of any win :(

  • Hi guys

I've received a letter today from HSBC UPHOLDING my complaint about a Loan and Credit Card. They have stated that they are unable to calculate figures as they are both older than 6 years. They have asked if I can provide evidence/statements showing PPI. I don't have this info as the Loan was taken out in 1998 and the Credit Card was taken out in 1996 and closed in March 2005. I provided them with Account numbers and PPI policy numbers.

I thought Banks were giving "Average Payments" for details that they no longer hold? I know LTSB are

Any ideas if I will get an average payout or do I need to raise further with FOS?

Has anyone experienced anything like this?

Any suggestions would be very helpful

    Thank You much x x x

Santander just like all other banks, are using delaying tactics as they clearly do not have the funds available. The next step is to give them 7 days notice or you will issue a county court summons which will include costs.

Do remember that if they accepted the claim, they have accepted liability. By selling you a policy that was not worth the paper it was written on, this is covered by the fraud act 2006.

    HOW WILL THEY RESPOND ?
FACING COUNTY COURT ACTION, will normally bring the response you need as the banks will not risk going to court on a charge of fraud.

Your job is to apply immense pressure on Santander and do remember the word FRAUD
