    First of all apologies if I am posting as a reply incorrectly, couldn't find a button that said 'post a new question'...

    I am trying to reclaim PPI back from Santander (nee A&L) for a loan that I took out in Aug 03 and paid off in Jan 06. I know it had PPI, which was sold as a way of securing the loan, but annoyingly, I don't have all the details of the loan (full account number), I only have the details that are on my credit report along with the address I was at when I took out the loan.

    After the first letter I sent Santander wrote back and said they couldn't find any details of the loan. I re-sent some details through and included the address I was at when I took the loan out. They wrote back today to say that they no have a record of the loan as they have deleted records 'in line with their retention policy'.

    I called the FOS, who agreed that the bank does not need to keep records for agreements older than 6yrs - this seems a bit unfair as the loan still shows on my credit report, and was in force less than 6 years ago.

    Can anybody advise of my next step, or do I have to accept that I cannot get this PPI back?

  • Deadline from Barclays was up on the 9th. Still nothing, Just tried to call their PPI number got passed around a few departments only to be told it was the wrong number. Now trying 0845 609 0806.

    Farce. If I don't get through I'll send a recorded letter. What is best to put in this letter?

    Hi Danny, a PPI is not security for a loan, it is supposed to be security for you should you not be able to pay. That is what all this PPI scandal is all about, in most cases you were never covered and it would never pay out.

    See the checklist below, if you can answer NO to one or more, you will have a claim. However as they do not have the agreement, you will need to prove to them you paid PPI..

    *Did YOUR BANK explain the full cost of the PPI when you took out the loan?
    *Did you specifically ask YOUR BANK for PPI?
    *Did YOUR BANK make clear that PPI was optional?
    *Did YOUR BANK ask you about your medical history?
    *Did YOUR BANK ask you about any existing payment cover?
    *Did you know that YOUR BANK added a PPI policy to your loan?
    *Do you think YOUR BANK treated you fairly?
    *Did YOUR BANK ask if you have any existing medical conditions?
    *Did YOUR BANK ask if you were entitled to sick pay from your employer?

    I think danny it depends on who at the fos you get to talk to sometimes, i have two credit card complaints in with the fos at the moment but the caseworker i talked to a guy called ryan who was really helpful said that the fos would pursue my cards even though there from 1992

    I did kez i did'nt get a lot of info though, i did get two credit card numbers not a lot else though i'm afraid

    Thanks its worth a go! I did have a cc with them but that def didnt have ppi lol :D
