  • the letter i had from Vicky Watts at Black Horse doesnt state final anywhere but i have sent 3 letters since the 16th September (this is date on her letter) and have had no reply. I read the letter again and it says this at the end:

    I trust i have clearly explained my reasons etc but should you wish to contact me direct my details are at the top of this letter. In the event that you remain unhappy with my decision you have the right to refer your complaint to the Finance and Leasing Association. Their address is provided in the enclosed leaflet. This complaint is not eligible for consideration by the Financial Ombudsman Service as they are only able to consider complaints regarding policies that were sold by us between 1st Dec 2001 and 31st March 2003 and from the 14th Jan 2005.



    What is my next step?? They dont seem to want to reply to me, it appears I dont have a case for review with the FOS??

  • Hi,
    With the Halifax CC it came with the bank account.
    I did not realise i was paying ppi until i questioned why my monthly payment were not covering my minimum because of an unknown charge(PPI).

    I do not have the account details for Citi finantial but i believe i did not have a choice with the PPI as i could not get the loans otherwise.

    Hope this makes sense.

    I'm hoping someone can offer advice.....
    I consolidated loans and debts with NatWest for approx. £15k going back to 1992 or was threatened with bankruptcy. The loan had PPI attached, paid as one off at the start of the agreement. I managed to pay off early and received a refund on the overpaid PPI premiums. I had no option to take out the loan or to protect myself if not they would withdraw the loan offer.
    Can I put in a claim for being mis sold even though I had a small refund? I have no details and the bank say if they can provide anything it will be the barebones of the agrerement, date, value, insurance etc, but am still using the same account the payments were made from.

    Any help/advice would be appreciated.

    You need to write to them and ask for all info they hold on you,enclose a cheque for £10.
    When an account is closed,they do not have to give you this info.
    Or just ring them and see if they can help you,as your request can take 40 days for info.

    Ring the bank and ask them if they can find the account,they should as you only paid it off last year,if you have internet banking,look on your dd list and the loan should be there and it will have the correct account number.

    Put in a mis sell,WHEN you win,they will take off the money you have claimed and if any is left over,this will come to you,the best bit is the loan monthly payment will reduce by the ppi monthly amount and the whole ppi comes off the balance,send this.
    We/I believe we were mis sold the ppi on the above account number,and would like recordings,if any to the contrary of my/our reasons for mis sell set out below.

    1)We/I were not told that the ppi was in effect another loan that was added to the original loan and was repayable over the loan term with interest.

    2) We/I were told that the ppi was a 5 year policy, but not told the ppi would still be on the loan to term end with interest.

    3) We/I were told that if we did not make a claim,or go into arrears on the ppi ,after 5 years we would recive the cashback of ppi but this would not include the interest made on these payments that we paid over the 5 years.

    In line with the FOS recommendations it is requested that the overall situation be restored as if PPI had never been included. This will entail:
    A refund of the monthly payments that have actually been paid towards the overall loan in excess of those that would have been needed, if the original loan had been sold without the PPI policy.

    In addition, interest at the rate of 8% simple per annum to any excess payments made from the time each payment was made to the point that Firstplus pays them back to us. We/i believe we were not given enough information on this ppi to make an informed decision. Had we/i known the full cost of this ppi we would not have taken it.

    Unless you can prove without doubt that this PPI policy was fair, reasonable and suitable for my/our circumstances we/I will require you to rearrange the loan as if PPI had never been included on the above loan.

    Do you have any dates for the Citi loans? Not having a choice is a good reason but a) you would need to be able to prove it some how b) you would need to get account numbers and if you SAR them they may be time barred and they may just say "no records" thus wasting £10, this one may be difficult as you don't have any evidence to back up your complaint.

    The Halifax CC may be more straightforward as you probably have dates, account number and paperwork but how did you get the CC? You say it came with the bank account, was this done by phone, on line or in branch? Was it advised (were all the terms explained to you, either verbally or via documents) did you have the right to cancel, CC PPI is normally on statements as a separate amount so that you know you are paying it.
    Don't let me put you off complaining but these are all questions you need to ask yourself, if you feel you were mis sold and have a valid reason (see reasons for mis sell in the link) download the questionnaire in Part 3 of the link I posted earlier and fill it in. Send it in recorded delivery and keep copies

    If you have reasons for mis sell and put a claim in,if your claim is upheld,they will take off what you have been given already,the rest comes to you.
    If you have internet banking,look at your standing order list,the account number will be there.
