Thanks to all the advice and encourangemnt I received from this website I put in a claim to Lloyds for PPI I was forced to take out on a graduate loan for £1500. In Oct I posted earlier in this thread that I had received a letter saying that they agreed with me and were offering me a payment of £393.51. The letter stated that if I was happy to accept this figure then I didn't have to do anything and the money would be sent to me. Fast forward a month to november and I then received a further 2 letters dated the 2nd and 7th apologising for the delay in payment and upping the payment by £1.28 so that the interest was calculated until the end of november. Today, still no payment has arrived so I have just rung the Lloyds helpline - 25min until the call was answered and then they addmitted that although I am now in a priority pile of claims where the payment has not been made within 28 days of the original offer, I still probably won't receive it until after Christmas!

Hi Beamerguy, thanks for the response.

Can you give me any more information about how the MBNA PPI was found to be fraudulent/not pay out? I want the reason I put for claiming to be as strong as possible from the start, and since I did tick the PPI box on the application form all I've really got so far is the lack of information about the policy, and maybe their failure to assess my suitability for the cover.

What, would you say, would be my most convincing argument for mis-selling in my case?

    Cheers!

It is operated by St Andrews part of LTSB. When the policy was sold, MBNA lied about the cover. When a claim was made, only then you get a copy of the policy. READING THE POLICY, it was clear it would never pay out. So, go through the check list and the most convincing argument is the word FRAUD

    You need to read this

As we keep saying, Lloyds are dragging their heals which we all believe is due to lack of money available to pay out

The answer is still the same people if you are thinking of changing your bank, LLOYDS TSB is NOT the place to go

    Hi all,

I’ve sent off my request for the credit agreement of a loan I had that was paid off a couple of years ago. After a few weeks Natwest finally sent me a letter back saying

    Natwest wrote:
Please note that Section 77(1) of the Act is only applicable to loan accounts that are still open

Whilst I don’t dispute their statement, I was wondering if anyone is able to quote verbatim a specific section on the Credit Act that allows debtors to ask for details of agreements that are no longer active. I seem to be unable to find one anywhere.

This may have been asked already so apologies for posting it again.

    Thanks :)

  • Hi
I took out a secured loan in 2006 through First Plus. I was made redundant in 2009 for 6 months and I was claiming on the insurance to make my payments.

I was made redundant again in September this year. I received a letter at the end of September stating the PPi policy was due to expire on the 12th October. I rang First Plus and asked if the policy could be extended but they said it couldn't, so I started to look around for an alternative policy. I phoned First Plus and asked them to let me know what the monthly payment would be now as the payment protection insurance had expired. They informed that the monthly payment wouldn't go down because, although the PPI policy was only for 5 years, the PPi total amount was put on top of the loan at the beginning of the agreement and then spread over the remainder term of the loan, which is over £100 per month.

Please can someone let me know if this normal practice as I feel I have been mis sold the policy as I dont see why I have to pay a policy for a further 10 years that isn' active anymore!!
  • Thanks Cappo, that's much appreciated :T

You're allowed to ask for anything they have on you within the last 6 years and they have to give it to you. That's under DPA.

  • Been turned down from Yorkshire bank for loans paid off in 1998 and 2001 for ppi refund, I don't have any paperwork from the actual loans, just statements were I made the monthly payments. But the loan numbers were on my SAR and were given to me from the teller when I enquired.

Yorkshire bank turned me down, I appealed with a letter help written by Beamerguy and Cappo so thank you both. Yorkshire Bank then said that they would reinvestigated. They even phoned me to ask about my statements, which i offered to send but they said that that wasn't any use.

I know I had PPI as a single parent they said I must have PPI to have the loan approved, the loan was to pay my overdraft and both were insisted on by the banks advisor.

Is it worth sending to FOS?
