I have just received the copy of my credit agreement form Lloyds TSB, well, they have provided a reconstituted version of my executed agreement applicable from 15/01/2011...they have also encolosed a copy of their current terms and conditions (effective form 01/02/2001).
They state that there is NO requirement under CCA to provide me with a copy of the original signed agreement. They endeavour to locate the copy of my signed agreement and set out an appendix of my rights under section 78.
They say they have satisfied the obligation of section 78 and will not be entering into any further correspodence with me regarding the copy of my agreements.
So, do i wait until they find my signed copy? or just go ahead with the second template letter?
Can they refuse to provide me with a copy of the original agreement?

I would get on with the reclaiming now, and not worry about that, as its gone 6 years since the account, its unlikely they will hold a true copy, and just as long as you have something to go by that is fine.
To reclaim, there is a reclaim questionnaire on this site, but its the same one on the lloyds website, so below is the details to Lloyds complaints and where to send etc, remember to save copies as well, good luck.;)

My partner took out a loan from Arnold Clark Finance around March/April 2003 and unfortunately has lost her paperwork so we have no policy number.
Is this going to be a problem when claiming and also wish to know if we are outside the time limits for reclaiming PPI?

Hello girls and boys
Hubby just had phone call from Halifax. I have telephoned my handler for the full details as he is not brilliant at the finer details. Anyway calculations done and letter in post (apparently sent 2nd class). Handler said cheque should be with us in about a week. Apparently interest added to 30 November so I asked her is that when we would get cheque and she said no it is so as to not financially disadvantage us. Grand sum to come back to us is £4938.78. (i think it should be 5.5 grand!!). Anyway some good news for once from me. Lets see if the cheque arrives - she did say to ring her back if it hadnt turned up in a about a week. I only rang yesterday to say that i was desparate as I have broken my tooth (which I have) and now need a crown. Happy Thursday people.:beer::j:j:j:j:j:j:j:j:D:D:D:D:D:D:):):):)

I was wondering whether someone could help me work out what I am owed for one of my Halifax Loans (I want to send the calculations to them as they seem to be 'struggling')
Loan taken out in 2004.
Cash Loan £11,300
Total Charge for Cash Loan £2,515.00
Total Amount for Cash Loan £13.815.00
Insurance Loan £2,399.75
Total Charge for Insurance Loan £534.25
Total Amount for Insurance Loan £2,934.00
I made 37 payments of £279.15 (before topping up the loan). The interest rate was 7.9% at the time.
This loan is now closed.
I would be very grateful for any help (failed my A-Level Maths)

This guide is designed to help you deal with debt collection companies who want to try and mislead you into thinking that your old debt can be legally recovered. Below you'll find all the information you need, including a template letter, to successfully deal with these chancers!
Consumer credit contracts like everything else in this world have a "use by date". In respect of credit contracts, this means that after a particular timescale the debt or contract can longer be enforced - its Statute Barred
What is statute barred debt?
Statute barred debt is debt which in certain circumstances becomes unenforceable in court. The piece of legislation which sets out these circumstances is the Limitations Act 1980. So when a creditor comes chasing you for an old debt you can use the following information to access whether or not your debt is time barred.
This is dependent on the type of debt you have. The most common form of debt which people ask about in our forum is unsecured debts eg credit cards, personal loans, store cards, catalogues, bank loans, finance company loans etc. The Limitations Act 1980 states that when the following conditions are met then the debt cannot be pursue through the courts.
The conditions are:-- That the creditor has not taken court action against you, eg CCJ, AND
- You have not made any payments on the debt over the last 6 years,AND
- During the years, you haven't written to the creditor acknowledging that owe them money.
Dealing with Creditors and debt collectors
If you are being pestered or chased by creditors about an old debt which you believe has been statute barred there are certain things you can do to stop them pursuing you.
1. Established whether or not there are any judgements made against you. This will involve contacting the three main credit reference agencies and checking your credit report.
2. Under the Data Protection Act 1988 you can also request a copy of any files the company has. You must remember when writing to the creditors that you are in no way acknowledging the debt. Use this template letter
3. Use this template letter to write to the creditor to say that under the Limitations Act 1980 the debt is now statute barred and you would like them to stop pestering.
Important
Keep copies of all letters and send them by recorded delivery.
Never sign any of your letters. Why? Well I am not one to cast aspersions, but some people think that some unscrupulous finance and debt collection companies have used the signature attached to letters to forged letters from debtors acknowledging the debt. I don't have any proof of this. You can make up your own mind whether or not you sign the letter.
When writing to any debt collection company, make sure you head the letter up, "I do not acknowledge any debt to you or any other company or organisation that you claim to be representing."

Hi billy ring ac finance first as they might give you the full details and even take your claim over the phone i would'nt say your outside any time limits i have claimed back as far as 1995 although this does depend on the lender, good luck.0 -
