    I would speak to your MP, who will on request contact them on your behalf, I don't think they'll ignore MP's to be honest, even though banks already have a reputation, I'm sure they don't want to make matters worse for themselves.

    Can anyone tell me how i go about finding out who an underwriter is?

    I have got a response back yesterday stating that a loan that we undertook from Endeavour Personal Finance ( your friends Di!! haha) - they are not responsible for the PPI but the broker. They said as we went through Portfield Financial services - it would be to them we complain, however, i have just been on the internet & found that Portfield we taken over by Norton...how do i get to the bottom of this??? lol..:o

    Also.. just an update on the car finance ppi where the signature was falsified as it was not my husbands :eek: - the garage rang my hubby - to which i told him to say all correspondence should be in email/letter :o . They sent an email to say they were dealing with it..then sent another back to say "they have spoken to the right people" - ( very professional) and although they have destroyed the original file - they have looked in the original file (query query) and the signatures are not identical, however, they can not do anything regarding paying back this ppi as they are "confused" at how we paid for it - even though it was incorporated within the DD....all emails received are from a sales rep within the garage, so it doesn't even appear that this complaint has been raised anywhere apart from the gag rage forecourt!! :mad:

    With regards to your response that your company have looked in to my complaint thoroughly, the objectives that you have arose to are not lawful and justified. Additionally, i totally disagree with your assumptions.

    As stated in your email, you claim that you are unable to accept any liability - this is untrue, as a financial association and a regulated company it is a fundamental aspect of your regulations that when evidence is provided to you, regardless of time and redemption policies, it is a lawful duty, for your company as finance providers to investigate complaints.

    With regards to the redemption policy which you claim is 7 years - this is irrelevant as i still possess the original document. Furthermore, regardless of time, as i have the original agreement, it is your duty to assess the complaint thoroughly, however, this has not be conducted. You also claim "within the original file" within your email, - if Volvo have adhered to their redemption policy, as you claim, how can you quote from the "original file"?, to which you claim the two signatures are not alike.

    You also go on to state that you are "confused" with regards to how i have paid finance without knowing that i was paying for something additional. As you were not there at the point of sale, so excuse me for saying - you cannot comment, but it was i who asked for the finance to be set for below £200 monthly, therefore i had no reason to have reservations with regards to the amount of my monthly payment.With regards to not noticing the PPI on my copy of the agreement, for your information, i was aware what my monthly payment was after point of sale when leaving the show room, therefore, i had no reason to scrutinize or dis trust anything with regards to my agreement. Additionally, i did not imply that the box was signed in front of me - i have stated that i did not sign that signature, so again you are assuming.

    I am aware of your position now and consider your response to be based on assumptions and not factual, rather than being fair and lawful. I am not prepared to participate in this dispute with yourself when you are, as stated above, not providing me with evidence as to why you are providing non factual information. I do not believe that you have considered my complaints in accordance to guidance that is permitted by the FSA. As i have stated before, i brought my complaint to you, as advised, which you have unsuccessfully addressed/escalated. This complaint should have been escalated within your company to senior management level, as at present, it appears this complaint has not been delegated to the appropriate person/department, therefore, once this complaint is escalated, senior management response will be customary.

    I will again, contact the FOS, FSA, ICO and the Citizens Advice Bureau tomorrow, to make them aware of your response and gain advice on further proceedings, as i am determined to prove that the signature on the agreement is not mine resulting in a PPI product being added to my finance, to which i additionally paid for.

    I will confirm to you tomorrow the direction in to which i will escalate this complaint.

    We await response with baited breath...we did ring the FOS and CAB, the FOS stated that we have a case but they need to know who the underwriters are..then they could also deal with the falsifiable signature.

    It's sickening..:(:(

    They didnt reply to the above email so i sent this yesterday:

    I am responding to the email that i sent to you last night.

    As stated, i have sought further advice from the Citizens Advice Bureau and the Financial Ombudsman Service today.

    As you are unwilling to deal with my complaint accordingly, i now have support to escalate this complaint further.

    Would it be possible for you to inform me with the underwriters that provided this PPI on my agreement?. I am unaware if your email that you sent yesterday was a final response to my complaint, as this was not stated. If you are providing me with a final response to this complaint i will proceed to complain to the underwriters.

    The FOS will write to you in due course in concern to this matter.

    I have a telephone consultation with an appropriate representative from the Independent Commissioners Office tomorrow and a telephone consultation with a legal team, provided through the FOS tomorrow. Therefore, i will be able to move forward with this complaint.

    I await your immediate feedback and response to my complaint.

    I'm sick to the back teeth of it all too sunny, I had my complaint upheld for my five loans with RBS to the tune of just over £10k which is great, but the most current loan was defaulted on about ten years or so ago, and at the same time as I had a mortgage with them, I voluntarily repossessed the house-handed back the keys myself-a couple of years later a debt collection agency found me and I signed up with the CCCS on a DMP with RBS and a store card agreeing terms, I paid off the store card and have been paying RBS for over 8 years now. Basically because the last loan had the ppi it needs to be restructured but because i've been paying through the DCA i've not been able to find out if it has been sorted out.

    I eventualy got through to be told my account had been given to another team, mortgage recoveries, so I spoke to them and they weren't sure but they had a note of a mortgage shortfall, but he would need to check and get back to me, which he did, I also started to check into this as at no point since I handed in my keys had I heard anything from them about this shortfall.

    When the guy phoned me back he told me i'd need to fill in an income and expenditure sheet to work out a repayment and I cut him off, to advise that I wouldn't accept that I owed them money and according to the Council of Mortgage Lenders that they had signed up to in Feb 2000 if a property has been repossessed and sold on and there is a shortfall, they have to chase the money within 6 years(5 in Scotland) if they fail to do this they can't decided at a later date to do this, he said he'd need to double check all of this and again get back to me.
    About half an hour later he surely called back to say they would be writing off the mortgage shortfall(I believe about £15k) he had worked there for several years as had one of his colleagues and they had never heard of this, but he had checked with the legal department and it was correct indeed, he didn't know how it hadn't been chased but was astounded and shocked at the same time.

    Anyway, had a long conversation about why I was on to him about the loan ppi complaint and he was able to tell me all about my my ppi amounts, even though the ppi team couldn't??!!?? he gave me the figures that I had in the letters, and there were notes on the system that they were just awaiting acceptance forms to come back to process the payments to my account. I told him my forms had been sent back Special Delivery and signed for on Monday but as of Wednesday according to the ppi team they hadn't been scanned in, so he said he'd fire off an email to someone he knows to see if they can locate them quicker and see if he could push it on a bit.

    Basically if it get restructured to what I think it should be ie, intital loan with ppi and interest being taken off to give a new figure, then with everything I've paid since should have a new figure which can be covered with less than half of my ppi redress.

    Long winded but good information for some folks.

    I'm hoping my figures are a bit on the heavy side as it doesn't take into account the difference of what my loan should've been as there had been refinance from a previous loan(well four others!) so the initial amount should never have been what it was, but we'll have to wait and see.

    Just to add, I didn't sleep for worrying about it overnight from Thursdsay to Friday as when I was expecting just to be back on my feet again, I thought I was going to be back in the same boat again, but thanks to some negligence on their part I may have escaped a bit of that, so I slept like a baby last night, phew.
