    I need some advice please!

I took out a loan with MoneyBackBank.co.uk in September 2005.

I don't have any of the paperwork to hand though, and the company (which is a subsidiary of Santander) no longer exists.

I sent a subject access request along with a £10 cheque to Santander asking for the details of the agreement.

I have just received it all back saying they don't keep files over 6 years old (it hasn't been 6 years yet).

I believe it was a 2 year loan, so it would still have been active in 2007, surely details of the agreement would still be on their systems?

Am I screwed because I don't have the original paperwork?

    HELP! :(

If you still have the loan account number and your reasons for mis-sell you can still claim against them, obviously the more details you have the better, but this is the least you should need.

As for not meeting the terms of the SAR, I think you should be able to contact the ICO - Information Commissioners Office, for more details, but they should be complying with the request and sending you everything they hold on you from their records, although, was it a SAR you put in or was it asking for a copy of the credit agreement, if it was the latter, if the loan has been completed they are not required to keep it after the loan is finished, but they should still hold the basic details, loan amount, ppi amount if any, interest rates for both etc etc.

Some of the other more experienced members may give more words of advice, good luck and keep us posted.

Trish, see reply above this regards your SAR, you may get some of the account numbers from your credit report, I'm sure some of the other forumites have done some back door ways of getting information, I think they contacted their bank that they made their monthly payments from and got them to trace the details from the direct debit info, I could be wrong, and I'm sure those forumites who recognise this story may be able to share some finer details.

Good luck and keep us posted.:D

Evening all, just a quickie - I rang First Direct earlier in the week to check up on a couple of PPI complaints (loans not CC) which I sent in early May and I was told 16 weeks which is correct, but the lady then said that the 16 weeks runs from the date that they sent out the "16 week" letter not when they received my complaints which puts me near the end of October not early September!

This has been wriggling in my brain for several days and I can't work it out - help please.

Its a load of rubbish they told you, its 16 weeks from the complaint. I sent mine at the end of May, rang this week to see what was happening and the lady at FD said there is a note on my file saying a decision has to be made by 12th Sept. I got my '16 week' letter sometime last month

Hi folks, following a recently upheld claim from Black Horse, I thought I would try with my Hsbc loan but not really sure if I'd have a claim or not?

I took out the loan in 2006 to consolidate on another loan and more debt that I'd accrued. I remember being made to feel really stupid by the lady arranging the loan that I was still quite young and was having to get a second loan to consolidate my debt as I had got myself in quite a mess! I remember being shown a checklist to see if the ppi would be suitable for me but don't remember being given a quote for the loan without ppi. I don't remember being told it was optional and because of how the lady made me feel in the first place I didn't feel able to ask.

As you can see there is quite a bit I don't remember about the sale, so I'm not sure if it worth pursuing or not?

Cheers, I used the SAR template from here, assuming the only data they would have on me was the loan as I've never banked with them.

All I want is the loan account number and the PPI charges as you have stated.

Will call Santander tomorrow, but I have a feeling the customer service dept won't be particularily forthcoming.

Santander might surprise you, some of the posts on here have been very appraising of them, they've been receiving complaints, and finding in favour within a week or so, and sending redress paymentsa week or so after that, maybe you'll be surprised.

  • Hi,

I had a barclays loan appromxiately 9 years ago, is it even worth me contacting them about the PPI on this considering it was before 2006?

    Thanks in advance

    Hi

It was weird how it happened with the halifax credit card, it's my mums. She had a letter just after JR to get in contact with them. Ive been on at her for a while to ring them.

Yesterday I got home from work, and she told me she rang them put her on hold come back and sed 'ok we have upheld your claim, cheque will be sent out you will get it in a week'.

Well I nearly fell over, never heard of it being that quick. :)

But as soon as anything comes I wil post it so you can have a look.
