I have been in contact with FOS for updates but they just keep saying my complaint is waiting to be allocated to an adjudicator and it could take up to 9 months for this to happen! They have heard nothing from barclays as well.

Sorry to hear of your issues here.
If you want to complain about a claims company I believe you would have to contact the Claims Regulation at first who will be able to direct you.

Explain your predicament with these first.
But you are able to query this I believe with the FOS, so also give them a ring as well.

Thank you but it is the FOS that I wish to complain about as they are doing nothing about my case and it has been with them since May 2008. I am so fed-up with them fobbing me of. I have put in a complaint to there complaints department and they haven't acknowledge it.:AI have 2 PPI claims all being dealt with by FOS could do with a win. I also have 1 PPI claim with FSCS because company gone bankrupt.
I have claim for bank charges on-hold for 3year

You made a good point here and what I would do anyway is still make a reclaim on the others, for example I lacked paperwork for some of the lloyds late 90's, even though I had the account numbers, they still refunded.
So the loan account they're paying out on, is this one older?
The loan that they are paying out on is the latest one I had with M&S and was closed in 2004. The others pre-date this. I have not claimed on these as I had no information and can only remember one which was refinanced by the last one in 1999. I have sent a SAR but not yet received a reply to that. They have added the other ones at M&S and say they are linked.
My main concern is that the initial letter says they are paying out on the loan and then a later letter says they have declined it. Do they just not know what each other is doing? Can they agree to refund and then change their minds?0 -
I complained to Barclays in August 2010 about a PPI I had been wrongly sold. They put my case on hold when they were challenging the FOS about PPI's this year, so I referred my case to the FOS. What I want to know is whether I am likely to get this goodwill gesture that people who made a claim before April 2011 are getting even though my case is being looked at by the FOS? I have not recieved any letters from barclays since they lost there case and when I spoke to them they keep saying they have till the end of August to sort out the claim. I have repeated ask them whether I will be recieving a goodwill gesture and they keep saying that my case is still 'active with them' and that they will get someone to give me a call to clarify this.....I am still waiting?

I have 2 Barclays loans with the FOS since February which were placed on hold due to JR.
I received a letter from FOS at the beginning of July saying Barclays were paying out and unless I declined the offer within 14 days of receiving the FOS letter they would tell Barclays that I would be willing to consider their offer of redress and Barclays would contact me direct before 31st August.
I was of the understanding that all Barclays complaints placed on hold and not issued with a decision before April (?) 21st would be paid on a no quibble basis, whether they were with FOS or not.0 -
Please help...In 2002 my husband bought a mppi as advised by a financial advisor employed by an estate agent and has paid premiums in good faith ever since. Recently he had an accident and when he tried to make a claim was told by insurance company that policy was invalid as he is not named on the mortgage and insurance company immediatly canceled policy. A letter of complaint was sent to them and the estate agents sometime ago now, the estate agengy phoned him to explain they were investigating the situation but in the mean time as a good will gesture would forward him some money to help whilst they completed their investigations. The insurance company responded by saying they would consider refunding the premiums but not interest as felt they were not liable for the misselling of the policy. we have been informed this week that the files needed by the estate agents have been damaged and cannot be retrieved and also the insurance company have informed him verbally that he cannot have a refund of his premiums after all as the estate agent had informed them that they would make payments as though the policy had been valid whilst my husband is off work. How can this be right? What should we do now?0

I was hoping this was the case and when I spoke to Barclays they seem to think my complaint would be looked at by the end of August. I am just a bit worried that because I sent my complaint to FOS that Barclays will just leave it up to them to decide if I am due my money back (which could take up to another 9months) rather than deal with it by the end of next month.:o0 -

Sorry about your situation. Just a warning that there maybe a very long waiting with FOS my case went adjudicator twice were it was up-help but the Ocean finance still wouldn't pay so I am now waiting for an ombudsman and have been for 8 month and the FOS just keep saying it is in a queue but my case in total has been with them for 3years and nearly 2 months since May 2008.
Ocean Finance have refused to deal directly with me as they say that I sent the case to the FOS so they will only negotiate with them.

hi thanks for replyingWas your loan on or after the 14th jan 2005?,if it was then the FSCS will deal with this,just asking,because the FSCS only deal with claims after that date and did not want you waiting again for them to tell you this,they are faster than FOS!!,so hopefully you wont be waiting months.
the loan was took out nov 2006 so will be fine being with the FSCS

Blimey, that should not be right, if in this scenario surely then they should offer this then as a goodwill offer, they should not in my opinion send you an offer (which you signed and accepted) then change their flipping minds.
I would speak to the FOS about this one and tell them you will be contacting the FSA, or contact the FSA anyway, this is not the way to treat customers.The one and only "Dizzy Di"
