I received a letter on 7th July from M&S saying they could find no relevant paperwork for a loan, paid up in 2004, so were rejecting my complaint. I sent them a rather cross email as this had been on hold for the JR. I also sent them the one update statement I had, although this did not show the breakdown of the loan.
On the 11th July I received a letter saying " I can confirm that after further investigation, aided by the evidence that you recently provided, I am upholding your complaint." I duly sent back the acceptance, which they have received.
Somewhat to my surprise I have today received a letter from M&S dated 19th July, giving a reference number I do not recognise and the one for my credit card (again acceptance of their offer already sent in). It gives 4 loan numbers, one of which is the one mentioned previously that I have accepted their offer on. I remember having one other loan but never 4. They say they are all linked.
The loan I have had an offer on the most recent letter states "due to the amount of time that has lapsed since the account was closed we're unable to locate the relevant application form" . As a result they are rejecting the complaint.
Is this a case of left and right hand? Can they rescind on an offer they have already made? If one can find the paperwork, why can't the other?
They say they are now investigating the other 3 loans and will let me have a reply in 5 weeks. If they are older how do they hope to locate those?
Advice please as to what I should do or say?0 -
hi everyone
received a letter today stating that my claim as been refered to the FSFC as freedom finance as ceased trading after waiting 7 months in the queue to go to the ombudsman! ( adjudicator had ruled in our favour but freedom finance disputed) claim as been going 18 months in total, does anyone know what happens now and how long the process takes? thanks0 -
Was your loan on or after the 14th jan 2005?,if it was then the FSCS will deal with this,just asking,because the FSCS only deal with claims after that date and did not want you waiting again for them to tell you this,they are faster than FOS!!,so hopefully you wont be waiting months.0

You made a good point here and what I would do anyway is still make a reclaim on the others, for example I lacked paperwork for some of the lloyds late 90's, even though I had the account numbers, they still refunded.

Does any one know how to complain about the FOS. 3 year 4 months ago I was called by a company claiming PPI had been wrongly sold.
I had tried to claim back bank charges in the past by myself and it went to court and my case got frozen at that time so I decided to let the solicitors claim for me.
Ocean finance were sent the letters by the solicitor and they refused to agree that I had been miss-sold.
so 3 years and one month ago it went to the FOS the adjudicator saw it up-held it but Ocean Finance still wouldn't pay out so it got sent to another adjudicator who again up-held so Ocean offered me £621 (I had paid £1800) they said they were knocking of £1200 for life insurance that they feel I would have purchased. The FOS said that this was not there agreement, so I declined it.By this time it was 2009.
It then when to the adjudicator again who up-held again and since then it has been waiting the actual ombudsman. I call and get fobbed of, I email and get ignored, my solicitor is rubbish and I can say that some of my emails have been less than nice. I am so frustrated, so frustrated that I asked the solicitor to ask for the first off of £621 losing a potential £1200 but I though some-thing is better than nothing (as I got nothing from the bank charges after waiting years).
The solicitor had to go through the FOS of-course and guess what it has been 6 weeks and there has been no reply.
The FOS have been rubbish in my case and I want to complain (which I have sent a letter of complaint to them direct and they have not even acknowledge it). Sorry to hear of your issues here.
If you want to complain about a claims company I believe you would have to contact the Claims Regulation at first who will be able to direct you.

I complained to Barclays in August 2010 about a PPI I had been wrongly sold. They put my case on hold when they were challenging the FOS about PPI's this year, so I referred my case to the FOS. What I want to know is whether I am likely to get this goodwill gesture that people who made a claim before April 2011 are getting even though my case is being looked at by the FOS? I have not recieved any letters from barclays since they lost there case and when I spoke to them they keep saying they have till the end of August to sort out the claim. I have repeated ask them whether I will be recieving a goodwill gesture and they keep saying that my case is still 'active with them' and that they will get someone to give me a call to clarify this.....I am still waiting?

Have you been contacting the FOS for updates as well? meanings you taken your complaint to them.
I would contact them and tell them your still waiting, but it seems a lot of others who've had cases with these are still waiting too, but what you could do is email the Chief Exectutive Officer (CEO) of Barclays, and tell them your not happy with almost waiting a year coming up, and your only being told the same thing all the time by the staff.

I have been in contact with FOS for updates but they just keep saying my complaint is waiting to be allocated to an adjudicator and it could take up to 9 months for this to happen! They have heard nothing from barclays as well.
I will email the CEO thanks for the email address and the advise0
