Hi, I would be very grateful for your advise.
I have send my letter to Capital One to refund PPI. Now I have received their letter stating that they won't give me a refund because I applied for credit 9 years ago over the phone and that means that I asked for PPI. I know that I haven't asked and don't know how to prove.They also said that they have sent me terms and conditions and if I would have read them I would have known that PPI can be cancelled. To be honest I probably didn't read terms and conditions. Do you know if I still can ask for refund of PPI? How can I justify terms and conditions not read?

If this was not the final decision, then write back and tell them you have only just became aware of the PPI mis selling issue and your not happy with the outcome of the complaint. Tell them you wish them to reconsider. Also tell them you are in your right to make a reclaim complaint with your reasons, despite the t&C's which were not clear enough or even made clear enough to you when they added the ppi to your loan. (tell them it looks like a lot of jargon) because it probably is.
What they sent you looks like a standard letter that most from this company have received.
Tell them in regards of their rejection, you are requesting them to send you a copy of the phone call recordings, tell them they must have these somewhere in the system to have told you that.
But otherwise complain to the Financial Ombudman Service (FOS) and still ask Cap One for the copy of the evidence of the phone calls that rejected your complaint.
Did they issue any details of the FOS with the letter?

Well well well, I wasn't expecting that!
I only emailed Lloyds last Friday, given some details from my old address, the approx years when the loans were taken out.
I had requested for the loan account numbers, and they got back today, however PPI was defo sold with them because then they stated it was all part of the loan, I do have some details but not a great lot, so am hoping they will be able to investigate on these ones now.
But............
for them to find these account number details, that does tell me they still hold details of the loans.

Hi everyone.
I've just sent an email to first plus asking for an update on my complaint and was about to do the same for my intelligent finance one.
However, on the update letter I received there is no email address and on their website you have to be an active customer to login and email :mad:
Would anyone know of an email address to use?

I take the email address was fine with FP, but you require the details for Intelligent Finance, I have added the FP addy anyway, but your right about having to have an online account with IF to be able to email them, stupid isn't it it?
Have you also tried ringing as another option?

Thanks, yes the First Plus email I sent it to was the same as the one stated.
I would telephone IF but the loan was in my husbands name only so I don't think they would speak to me - quite rightly so.
How long do you think it should take FP to respond to the email?

Arh I see what you mean, if the account in hubby's name your correct that they will only correspond with him in regards of the complaint.
I am unure of the closing times, but can understand it can be awkward for your hubby to contact them if he works perhaps the same working hours as the offices, or I was going to suggest that he try when he is able to.
I will try asking around for the CEO email as well for (IF) and if I get some joy I shall post back as soon as possible.
I would chase FP up if its been a few days.
I have never had any dealings with these myself but I believe 2 days is ample time for them to get back to you.
Keep chasing them otherwise.
