    which bank is it?

    as most have been granted a 16 week time scale to reply by and a deadline date of the end of august for most complaints that got put on hold by the JR. so may be too soon ;)

    I wasn't going to have a shout, merely ask for an update.

    I figured waiting until 16 weeks would be the best plan.

    Which is virtually 31st August as it happens.

    im pretty sure most people have had a letter to inform them of this, so it may be worth asking for an update as its been 8 weeks and you hadnt been made aware of the 16 week extension. ;)

  • We have received a letter stating that this B Soc is unable to resolve the dispute within 8 weeks and notifying us that we have a statutory right to approach the Financial Ombudsman. This is yet another delaying tactic as, on speaking to the Ombudsman's office, we have to register, provide copies of all correspondence/paperwork. The Ombudsman then writes to the B Soc asking them to provide correspondence and state their opinion. There is a significant backlog of work at the Ombudsman's office ...so you just wait all over again. Anyone done this successfully yet?

    We have therefore written back to the Principality stating that we will not progress a complaint with the Ombudsman and that we expect them to expedite the complaint asap. We cannot telephone the complaints department at the BSoc (voicemail is switched on and this is for internal purposes only; telephonist will however take a message and the department should ring us back). The department has 3 people....:(

    I have received information back from Lombard today as sent them a SAR regarding a loan I had with them back in 2001. They have sent me back the Agreement Form 1 where I have signed the form. Part 1 of the form gives my name, address, date of birth and employers name. Part 2 give me the loan amount, interest etc., and includes repayment protection premium of £1614.74 - this information is all on the same page as my signature box.

    They have also sent me terms and conditions of insurance plus certificate of insurance which states under 'who can be insured' that you must be in full-time employment! I wasn't, as worked for a charity 15 hours per week at the time.

    So not sure what to do from here. As much as they have not sent me confirmation of this information, they would have asked me to confirm my salary at the time of applying for the loan £10,000 and details of my insurance etc., so would have know that I did not work full-time. But they have my signature on the loan document agreement to the loan but not actually agreeing to PPI even though it states PPI on the document.

    So I had PPI which was useless to me, they should never have included it, etc., but you know what banks are like, you had a chance to cancel etc., but actually totally naive at the time and probably did not realise I had an option.

    I am planning on sending in a mis-sold PPI questionnaire to them now, but would like any feedback from people with similar complaint to do with Lombard or other banks, so thanks in advance for any advice.

    Hi and welcome

    Your from my neck of the woods then?:D;)

    Normally we have to give the banks/businesses 8 weeks as a normal procedure, if they do not deal with complaints in that time or have ignored the complaint, then normally you do have the choice of taking your case to the FOS.

    However, what I would do, is email the Chief Executive Officer (CEO) of the business to chase it up, maybe they will get back to you quicker this way, good luck.

    Just a thought, but as you do have a good case here, maybe if you could provide any proof in regards of you working 15 hours, that will be a help to your complaint, so basically despite PPI being added, the policy was worthless to you, and basically have deprived you of your money for paying on a policy that you would not be able to use.
    Make them aware of that, maybe if you received working tax credits, any details from them would help such as an old award notice, maybe the HMRC will provide these details to you on request perhaps.

    Good luck and get completing the reclaim questionnaire anyway, you do have good enough reasons, even if your unable to provide the evidence to them, they must take this into consideration.;)

    Hi Di and thanks for your reply.

    I do not have any old pay slips going back that far anymore, and HMRC seems to take ages, but my main concern here is that Lombard (and others like Santander with store cards that I had) just come back and say you were sent details the onus was on you, etc., etc., and that's that!!

    I think the onus should also have been on the organisation to check details of the person thoroughly, but they seem to be getting away with this. Again, it seems we have to prove to them, not they proving to us!!

    I will complete the questionnaire and send off this week, but I feel they have withheld information from me, like salary etc .,
  • i took out a credit card with alliance and leicester 8years ago it is still active i couldnt remember the policy details for my ppi so i rang them( now santander) to request them they told me they would look into it got aletter a week later telling me it was taking longer than expected but they would be in touch recieved a letter 2 wks later telling me they were upholding my complaint and worked out i was owed £2,2000 which would be credited to my account i am amazed i didnt fill in any forms and didnt really make a complaint i just requested my policy details!

    Hi, I would be very grateful for your advise.
    I have send my letter to Capital One to refund PPI. Now I have received their letter stating that they won't give me a refund because I applied for credit 9 years ago over the phone and that means that I asked for PPI. I know that I haven't asked and don't know how to prove.They also said that they have sent me terms and conditions and if I would have read them I would have known that PPI can be cancelled. To be honest I probably didn't read terms and conditions. Do you know if I still can ask for refund of PPI? How can I justify terms and conditions not read?
