They rejected my claim so its off to the FSO
Quite honestly, we could cut out the middle man and just go straight to FSO with Capital One!:mad:
Surely, since their default position is NO..the FOS must be catching on to this and question whether or not they are giving due consideration to claims..??0 -

I have today received another letter from Barclays stating that I will hear again from them by the 17th or 25th August. This is another set back because the previous letter stated they would make a decision by 30th June, this as probably been extended due to the FOS granting the banks longer. My question now is my first letter was sent to them 18th April 2011 first class by recorded delivery. This is 2 days before the deadline which Barclays announced last week regarding paying a goodwill gesture. Although after my letter of the 18th April I received one back explaining I did not have PPI on my overdraft which I then had to reply correcting them explaining it was regarding my loan, but this does not change the fact that my first initial letter was sent on the 18th April which I am sure would of reached them by the 20th.
Would it help if wrote a letter back explaining that my initial complaint was sent on the 18th April or maybe a phone call?

As stated above Barclays promised to get back to me on two separate dates in August. I have calculated this to be 16 weeks from my first correspondence. In the last week I have received two letters from them basically saying that there investigation is taking longer than anticipated & If I wish I can contact the FOS. I am now concerned at why they have said this. Anyone else had a similar letter?

Don't worry tony,they are suggesting this to everyone now,i'd deffo hold fire the bank are going to sort this out far quicker than the fos could, as for you sending your complaint in on the 18th,was it you i talked to before about this? check your recorded delivery stub and see when barclays received it, any time up to and on the 20th and your ok although it does sound by there response that they did'nt receive it in time, be patient though if you have been misold you will get your money back.0 -
hi k77mss thanks for reply. same has happened to me .Mark smith told me to try complaining to first plus again tried but they wouldnt except complaint:mad: Mark smith told me someone had had there complaint it must have been you he was talking about lol. FOS have told me will write again with an update by 30th of september. ITS PAST A JOKE NOW my complaint been with them for well over a year now and still nothing. Mark Smith i told i felt as if something untoward was going on behind the scenes and he said they would not be paying us anything and were trying to make barclays responsible? how long do u think this will take? is your complaint with fos?0

Just for information really - i contacted the FSCS today re my initial enquiry i put in on 27th june to see if i was likely to receive anything from them soon.
i was informed on the phone that the enquiries have now passed to a different team within the FSCS and this team are dealing with a backlog of enquiries. they have only just started assessing enquiries dating back to the beginning of june so said i should expect a bit of a wait before i hear anything back from them.
I was told it was worth calling every couple of weeks to keep bugging them and to keep up to date on any movements.
