PPI
You are no doubt aware that despite the recent court case, Banks are using tactics and excuses to delay payments or not to pay back at all.
This is well highlighted on http://forums.moneysavingexpert.com in the forums section

CAPITAL ONE
Capital One being the worst offender but according to these forums, it appears the FOS actually backs them and finds in favour of them
The General Public ARE GETTING SERIOUSLY ANNOYED especially as the Banks commmitted fraud by mis-selling PPI's.
The Banks stole money from its customers.
Are you going to just watch while the Banks take the upper hand over you, basically waiving "two fingers" at the government, the Financial Services and the FOS, let alone the High Court.
I suggest you read these forums so you can see at first hand what these Banks are up to.
It is noted that some banks have been given an extension, no doubt they are the ones who committed the largest frauds.
This is a complete scandal and steps should be taken NOW to ensure the banks repay ever penny they stole from their customers in the shortest possible time.

I have received a letter from M&S Money rejecting my complaint about PPI on my credit card.
There main points are
I completed the application in store and M&S Money not present so no advice could have been given, sale unadvised and all my points about lack of advice therefore refuted.
Policy charged monthly so I could have cancelled anytime.
I received policy documents and I should have consulted them.
At the time M&S Financial services acted as an unregulated intermediary.
By signing the contract I confirmed I was happy with the application.
My reply would be
I am aware the original store card was taken out 26 years ago but this was then transferred to a mastercard at their request. I know I had to complete and send off a form but can remember little of the details and obviously PPI was still added.
I am not aware I received any policy documents at any time.
Why did they reply on 26th April stating that PPI sold in accordance with requirements at the time so would normally reject my claim but could not do so as were waiting for the outcome of the JR and depending on the outcome of that, would have to re-review my case. Why not reject it immediately?
Should I write to them stating the above? Are my points reasonable or should I just sent it to the FOS?0 -

The PPI cannot be considered as a legal contract as it was sold by a shop worker, suggest you actually contact the CEO of M&S and issue a complaint0 -

If they did not give you a final response and you can take this to FOS,then send it,if it was a final response,then send it to FOS as M&S will not deal with you now.
Doesn't say a final decision but also doesn't invite comment!
It just says, Due to the reasons stated above I reject your complaint and we will not be offering you a refund.
It enclosed a copy of the FOS leaflet.
I really don't understand why it has taken them so long to reject it when the complaint went in in January.0 -
