    I complained to the FOS last week but I've no idea how long they take to respond. I think Cap 1 are hoping peaople like us will get fed up and go away . I intend carrying on.
    Good luck contacting the CEO - I'll do the same if I get no joy from the FOS

    after getting message fom postmaster saying delivery was delayed to yorkshire bank on monday, got the following message through this morning! hopefully have more luck with the email i sent to CEO

    hi i email the ceo and i got a letter saying they only had my last account for ppi any help i dont knowwhat to do now x
    Hi there, just been reading your past posts, how did you get on with your claim with clydsdale last may? you posted regarding a loan with them, did you do the reclaim then?.

    On their web site they boast

    50 million customers ??? How many of those have Capital One ripped off ?

    If you are an employee of Capital One and speak on the phone to customers regarding fruadulent PPI's, be ashamed of yourself

  • Hi, I got a loan out in 2004 with ppi on it but have now lost the paperwork. I used your template letter asking for a copie of agreement and t&c and enclosed a cheque for £1. The bank (barclays) wrote back saying their system shows that there is no sum payable under the credit agreement and therefore there is no requirement for them to comply with my request. I am sooo confused as to what to do now.

    could i just confirm some information please?
    as my secured loan is still running (and will be for another 14 years), would any reclaimed ppi through the fscs be paid off my loan amount outstanding, or would i receive a cheque if successful in my claim?
    i only ask because we are currently on a dmp, and it almost feels that money to help pay off the multiple creditors we are dealing with through this would be better than money coming off the outstanding loan amount. are there ways to request something different to the norm, in cases such as this?

    When did this loan finish, and do you have the settlement figure and date?.
    Do you have old bank statements that show the loan payment,this may have the account number on.

    Failing that you will have to request all info they hold on you but this will cost £10, but it will be worth it if you get the info you want, give them as much detail as you can about you and the loan.

    Better still ring them up and ask them to find you,as your details may be in the system.

    Hi Jessica

    I take it the account is no longer active?

    In this case apparantely they are not obliged to send the copy of the agreement as they may not any longer hold this actual paperwork as such, but they should still hold details of the account going back the last 6 years at least.

    However, its not stating that your unable to make a reclaim, you can still do this, and if you have your loan account number and know you were paying and mis sold ppi, give it a go, I did without my loan agreement - T&C's and was successful.

    So you can do this by just completing the reclaim questionnaire as on step 3 below, send to whoever sold you the account, head office or complaints dept and allow 8 weeks for a decision, keep copies for yourself as well, hope this helps and good luck.
