On the big LTSB countdown now 10 days to sar day, they still havent admitted i have ppi on my credit card so we'll see what the sar uncovers.0

If you did not agree and they cannot prove otherwise, again it is theft and fraud, so demand your money back.
Tell you what folks, with all this about Capital One, and I think it's just the tip of the iceberg, they must be investigated by the Fruad Squad
Yes it is Capital One. There appear to be more and more of us who are being lied to and fobbed off.
Apart from going to the FOS I don't know what else we can do :mad:

Let's base this on a PPI costing £10 per month to which most are not worth the paper they are printed on.
10,000 customers paying £10 per month = £100.000 per month
Over 12 months that = £1.2million
Over 24 months that = £2.4million
If we then say that just 6 banks were involved in mis-selling
Over 24 months, that equals a staggering £8.4 million that the banks took under false representation and promises.
If you sit and think about this, I have only shown figures for 10,000 people, what if its double or treble that or even more???
We will probably never know but this has very SERIOUS implications for the banks and it's going to get worse for them0 -

Capital One are now coming to the forefront of this almighty scam and fraud.
For the moment you must keep hounding them, do not be afraid of saying they are fraudulent, pretty sure they are aware of that now.
We must all question the FSA and FOS as to why they are allowing Capital One to lie and fob people off. The letter from you to them would not go amiss, if everyone did it, they would have to investigate.
Also, lobby your MP and ask the same questions, it is only a matter of time now with Capital One and the other rogue banks0 -

firstly, well done to everyone who has been successful so far - and good luck and keep plugging on to everyone still fighting against what can only be described as shocking behaviour by some or these banks and other companies.
i contacted the FSCS yesterday, putting in an initial enquiry into reclaiming my missold PPI money from Picture Financial. My question is - does anyone have a rough idea of timescales for claiming via the FSCS? i have read on a few posts that banks like lloyds have been telling people they will know within a certain amount of weeks (and then move the goalposts when it gets to this time limit), but is it any different in my situation because Picture has gone into default?

I bought a car from a dealership and had the finance via the Funding Corporation in October 2004. I told the sales person when I viewed the car (approx a week before signing the docs) that I did not require PPI and, I told them I only wanted to take out the GAP insurance. Anyway, in mid 2008, me and my wife were going through our documents and she questioned me about the PPI I was paying... That was the first time I became aware of it and that I was paying £95 a month for it over a 5 year credit agreement. I contacted the Funding Corporation within days of noticing it and they fobbed me off. In 2009, I contacted a PPI reclaims company called Gladstone Brook who told me that I did have a case, as I was not in full time permanent employment and, I was not explained the T&C's. They then told me that because the Funding Corporation was not regulated by the FSA until Jan 2005, they cant help me. I then tried again to resolve this matter with the Funding Corporation and they sent me out proof of my employment status that I signed. I did tell them that I was only in the office to sign paperwork for about a minute or a minute and a half and, they told me it does not matter.
In early 2011, I used a friends company to reclaim the money as I was told that I just need proof of my employment and they sent a letter off to the Funding Corporation. The Funding Corporation replied by saying that the case falls under the Limitation Act - Statutory Bar. From April 2011, I have been trying to win back my money as I had a proper look at the employment status doc they sent me, and I have found that the details I gave as my employer in 2004 was for the temping agency and I never saw this document until I received a copy in 2009. Also, I never ticked the boxes that were ticked on this form and they do not match my hand writing. Most recently, I have emailed the Funding Corporation’s directors and I have put forward a Subject Access Request...
I want to take this to court as I have been robbed by the Funding Corporation and, I believe they have fraudulently ticked boxes in my employment status to make out as though I was in a permanent job at the time (in 2004). I even provided them with proof from the temping agency that I was working through them.
Can anybody help me as they have charged me for not being able to make payments on time on the HP, due to them taking too much without me knowing about the PPI from October 2004 to mid 2008 and, I never cancelled it as they were only giving me £86 off in 2008.

Hi, if you believe that they ticked the box without your permission and the writing is not yours, then tell them this with a warning that if they do not repay the monies, you will issue a County Court summons against them to let the court decide. No financial institution wants to go to court being charged of fraud0 -
Spoke to the adjudicator today who advised that although Capital One will not apply redress they will put our loan account into a position as if we had not had the PPI prmium in the first place. When the say they will not apply redress they mean they will not refund any penalties applied to us for missed premiums paid.....thankfully this is not the case so is not an issue.
So we get the loan back to position we should have had in the first place plus refund on premiums plus 8% interest which is what we were aiming for.
Thank you everyone for advice, this all started when I did a google search to find out if we were going to get shafted on the Cashback deal.....opened our eyes to this PPI con and hopefully this will be all be resolved soon. It's taken over a year but again thanks to all; this forum was such a big help.

So far we have paid all premiums to date and we continue to pay this premium as our complaint is ongoing. FirstPlus refuse to payout the cashback due to our ongoing complaint with CapitalOne - can they do this?The adjudicator is in agreement that we have been mis-sold and our complaint is waiting for final decision from the Ombudsman.
You asked if FP could withold the cashback, that is why i answered the way i did re the cashback,as i took it as you meant you wanted the cashback as wellbut the ppi will be cancelled now,so that is not an issue anymore

My Barclays Small Business Manager, when as a Self-Employed person I was asking for a mortgage on some business premises for my wife's new venture, told me there was no way he'd OK a mortgage for me unless I took out a Barclay Life Insurance policy to pay off the mortgage in the unlikely event of my death; so I complied. Well, you do don't you. He also never told me I could have bought a similar product elsewhere. I had never previously had life insurance even though I had had a mortgage before, & now that the mortgage in question has been repaid, not had one since.
I've looked all over the site & nowhere can I find this instance covered as a case of PPI misselling.
I will be contacting Barclays & have downloaded the templates but, can anyone advise me if I have a case in principle & has my particular variation been covered or discussed elsewhere on this excellent forum & website?0
