PPI Reclaiming Discussion part 4

Hiya All
Been reading these forums for some time now and taken some positive action from all the comments and success stories so thankyou. My latest challenge is with Capital One...Joy
Long story short is that i challenged the PPI in the usual way and got the usual 8 weeks looking into it letter etc.
When i signed the agreement in 1997 and kept a copy for my records clearly showing "i did not require PPI".I sent this copy with the forms only to get a reply saying that i accepted PPI in 2002 during a telephone conversation(March2002)and through a adminstration error they never took the PPI out until June that Year.
I guess i could go through FOS as i have the evidence just wondered if anyone had a short cut i.e phoning them direct and challenging the PPI being added 3 years later etc.
My challenge would be along the lines of they should have not pestered me with PPI sale 3 years later as i clearly stated from day one i did not require it.
Any helped is much appreciated
Thankyou
I think we should start a new forum for Capital One, what say you Cappo and Di ?? Anyways, wilson8, if you did not agree to the PPI, AND THEN they purport you did during a telephone conversation, you need a transcript of that conversation so they can prove this to you :rotfl:
I would suggest that the admin problem is just a load of old bull.
VERY SERIOUSLY THOUGH, if they took monies from you without your permission, that is theft which is a criminal offence, couple that with the PPI's which are utter rubbish, you can join theft with fraud
Any fool and his dog can say " you agreed by phone" BUT .... where is their proof to this.
Hit Capital One hard ... tell them it is theft and fraud, they stole your money after all. They have stolen money from thousands of people as this forum is starting to show
You know what guys, if I were the Marketing Director of Capital One, I would be shaking in my shoes due the utter damage this forum is doing them. Mind you, it's well deserved :rotfl::rotfl::rotfl::rotfl:0 -

So we get the loan back to position we should have had in the first place plus refund on premiums plus 8% interest which is what we were aiming for.
Thank you everyone for advice, this all started when I did a google search to find out if we were going to get shafted on the Cashback deal.....opened our eyes to this PPI con and hopefully this will be all be resolved soon. It's taken over a year but again thanks to all; this forum was such a big help.

Well done Jas, one down, 1000's to go:T:T0 -

Thanks Beamerguy i will give them a call tomorrow and let you know how i get on.I very much doubt that they will have a copy of the conversation so as you say they cannot prove i agreed to anything. Also it's a little strange why they started to take the payments 3 months later and put it down to an "admin error".
Yes I would query that as well. They have been known to apply PPI's to accounts without the customer knowing. You may have just opened another can of worms so here is general question to the readers:
Have Capital One applied PPI's your account without your knowledge ?
We want to hear from you please0 -

What fabulous news!!!! Congratulations, and well done for hanging in there!
Am delighted, it's always great to hear of successes like yours, hope MBNA give you the same result! x:j:j0 -

Hi there,
Good point made here...
I have only been with the forum a short time, and it's clear that Capital One are one of the worst offenders in terms of lying to their customers, treating them badly, or downright stealing from them.
It might be worth gathering numbers of reclaims from the forum, what we need to see from Cap One, is the same, "no quibble" promise that Barclays issued. ( Whether they would honour it, may be another matter) but it's obviously time that they were exposed for their sharp practice!....The only excuse they haven't given, is that the dog ate the paperwork!!:rotfl::rotfl:
It's also reassuring to see some success in reclaim from Cap One, it was starting to look as though sending claims through to fos was fruitless!!
We just have to keep at them.....:)0 -

Hi all,the sheer weight of numbers must surely start weighing the fos down soon, how much longer can they (the fos) scream non advised sale, after all are we expected to sell insurance policies to ourselves, as laymen we don't have the experience to do that, all non advised sales should be banned. I think ppi has shown to have been missold massivley, look when cap 1 got fined 50,000 people were sold insurance without a policy document,i know i was one of them unfortunately for me my card was sold 6 weeks before the fsa started regulating the insurance side of capital one and the fos despite my always defending there honour on countless occasions have been worse than useless with my case, as beamer says keep on at them maybe the new regulator migt be up for doing something for all these crooks who hide behind a "non advised" tag.0 -

Hi bear we've had this before,i might be wrong but i don't think you would have ppi covering an overdraft,i've certainly not known overdrafts to be covered this isn't an asu (accident, sickness, unemployment) policy is it?0
