    Hi!

I had an A & L loan which finished in 2005. I rang Santander who gave me the following address: ARCHIVES TEAM, SANTANDER, PO BOX 1111, BRADFORD, BD1 9NQ. I sent for my copy of agreement on 03/06/11 but havn't had a reply.
On Di's advice I rang Santander today on 0845 600 6014 to see if I could get the Account No. etc & spoke to a lady who told me it is the right number but only available between 9-5. She advised me to ring back tomorrow and press option 2 and option 2.

Going to try in my lunch break tomorrow. I will let you know how I get on! Wish me luck!!

    Hiya

Glad it was the right number:T and wishing you luck x;)

I look forward to receiving my SAR from Capital One to see what was on my application form as anything I can get out of that bunch of halfwits is a bonus. They logged a default against me without giving me the 28 days notice, they gave notice and then logged it even though I paid the outstanding amount in full at the time. I have been arguing with them for years over it and this time (the third time I have tried) they have actually confirmed they have received the SAR request. Sending it to head office means it gets binned without anyone forwarding it, you actually have to send to the executive office.

The default expires in 2013 but will cause havoc with getting a mortgage when I want to move next year so hoping I can find something in the SAR that proves my point. If I find I was paying PPI as well then there will be a complaint against that too.

TWO RIGHT - I TWO CANT WAIT for them to get what is coming to them.

my story same as yours bearing in mind ive been with them since 2000 paying £30.00 a month only for my claim not to go through as i didnt claim JSA when made - then on top of that they gave me a ccj.

When i get the chance im gonna deal with their case.
  • Evening all,

Just a quick bit of info for other people in a similar situation. Won a reclaim case on Saturday morning against RBS. I have another claim which they originally rejected with the FOS. Adujdicator upheld my claim. RBS refused to accept decision beacuse of JR. Case now off to Ombudsman.

However, sent e-mail to RBS stating that reasons for mis-sell for both claims was the same. The one with FOS was not officially rejected.

They have e-mailed back today saying they will give me decision with 7 days.

    Worth others having a go.

Was patiently waiting to hear back from Lloyds about ppi on two credit cards. After having the standard letter about "dealing with my complaint and it may take up to eight weeks" I was at week seven and thinking something may happen soon. Then yesterday I got another standard letter saying it may take up to sixteen weeks. I see from other posts that this is quite normal but does any one else feel that whatever their time limit they will take all of it. I appreciate they are probably snowed under with complaints but at the end of the day its their mess and its our money they are holding on to. I'm having a bit of a hard time financially at the moment, like many people are and wish all this waiting was over. Sorry to all those who have been waiting a lot longer than me, just needed to have a moan lol

    It is frustrating isnt it?.
I believe they will deal with this a lot faster than the time scales they have given.
Hopefully this will all be dealt with sooner rather than later.

    Hiya All
Been reading these forums for some time now and taken some positive action from all the comments and success stories so thankyou. My latest challenge is with Capital One...Joy
Long story short is that i challenged the PPI in the usual way and got the usual 8 weeks looking into it letter etc.
When i signed the agreement in 1997 and kept a copy for my records clearly showing "i did not require PPI".I sent this copy with the forms only to get a reply saying that i accepted PPI in 2002 during a telephone conversation(March2002)and through a adminstration error they never took the PPI out until June that Year.
I guess i could go through FOS as i have the evidence just wondered if anyone had a short cut i.e phoning them direct and challenging the PPI being added 3 years later etc.
My challenge would be along the lines of they should have not pestered me with PPI sale 3 years later as i clearly stated from day one i did not require it.
    Any helped is much appreciated
    Thankyou

In the first instance you should forget the cash back, cap one are giving you redress for the "mis sell of ppi", what you should do now is get on to FP and tell them you have had an offer of redress from cap one and you want to claim the cashback and for them to take this off the loan and adjust your payments and balance in line with that.

If you dont do this, you will pay a lot more back in interest over the term of the loan, especially when the BOE raise interest rates, your loan apr will just keep increasing (as FP increase rates when they feel like it, as it is "prudent" for their business) so you need to get the loan reset with FP to save you thousands of pounds.

It would be nice to get the cashback but at what cost? a loan that will still have the ppi on that you cant claim because the 5 years is all it runs for, the best you can hope for is that FP will do this, if they dont agree, go back to the FOS and ask them if they can do anything about this.

You are entitled to the cash back, this is in your agreement, but you want it taking off the loan and your balance reducing and monthly payment, hopefully you can get this done.

The redress from cap one is the 61 months ppi monthly payments you have made with interest and the 8%, you will have a nice little windfall here and if FP get their finger out, a reduced monthly payment and loan balance and a nice little cheque in the bank.

Spoke to the adjudicator today who advised that although Capital One will not apply redress they will put our loan account into a position as if we had not had the PPI prmium in the first place. When the say they will not apply redress they mean they will not refund any penalties applied to us for missed premiums paid.....thankfully this is not the case so is not an issue.

So we get the loan back to position we should have had in the first place plus refund on premiums plus 8% interest which is what we were aiming for.

Thank you everyone for advice, this all started when I did a google search to find out if we were going to get shafted on the Cashback deal.....opened our eyes to this PPI con and hopefully this will be all be resolved soon. It's taken over a year but again thanks to all; this forum was such a big help.

    Hi there

Personally I think you have a good case, and would definately complain to the FOS and enclose copies of your evidence, wishing you luck on this.;)
