    Hi all

Just received my response back from Grattan regarding an old catalogue account I had with them from 1993.

They are unable to uphold my complaint with regard to PPI being charged on this account as the premiums was clearly shown on monthly statements sent to me and that all their policies were optional etc., etc.,

This seems to be one of their 'get out' excuses now - that the PPI was shown on monthly statements so I should have cancelled it then. I agree it was, but I think so many of us were taken in to believe it was part of the account, and we had no option not to have it. I was a housewife at the time and this insurance meant I could never claim on it and before they come back with another excuse regarding partners - my husband has been self employed since 1984 so again the insurance was useless to us.

I realise this is a complaint going back many years, but I feel so angry that they charged me for insurance just to make more money out of me.

They have also made it clear that the issues I raise fall outside of the jurisdiction of the FOS owing to the length of time your policy has been 'in force' - I think they mean closed. But am very tempted to send into the FOS anyway. What do you all think?

I would certainly ring the fos beverley and see what they say, what have you got to lose?

Great idea Cappo. The banks are no doubt doing this on purpose. RBS is clearly in the lead when it comes to delaying tactics and bad behaviour. We will need quite a few people though, lobbying your MP can have good results as doubt they aware what the banks are doing.
Everyone should at least contact their local MP by email or letter

You could find out who the insurer was, you then put a claim into them, and when they say "get lost" you can then take it to FOS.
If you go to FOS now they will make you wait for weeks to just to tell you they have no jurisdiction.
    Hope this helps.
  • Hi

I submitted all my questionnairs and am slowly getting my responses. So far

Abbey - (GE Capital) - sent a copy of my original storecard agreement where I supposedly ticked the box for PPI. It is so blatently obvious that I didn't tick it as my ticks are the opposite direction. So they say I have no case. They have told me to contact the FLA if I wish to persue.

Littlewoods Index - They say I agreed to the policy and I could have cancelled at anytime so they are closing my case.

Fashion World - They say the account was opened over 6 years ago, they do not keep records going back any further so I have no case.

RBS - I subbmitted copies of both loan agreements, which were sold over the phone. The 2 PPI's in this case total almost £9000. They first came back saying my signature on my claim form didn't match their records, then they said the PPI ref numbers were invalid. I'm now waiting to see what crap they come back with.

Originally I was looking for approx £15,000 back in charged PPI. At this rate I'll be lucky if I recover my recorded delivery postage. What upsets me is this is all money I unwittingly paid out and so desperatly need back.

    This really does suck.

There is some guidance in the FOS handling guidelines/manual for companies and in my interpretation of it, it clearly states that regardless of when the policy was sold it should still be given the same consideration as their checks and mystery shopping prior to the guidelines of 2005 showed up just as much mis-selling as post 2005.

cappo, I think you might have a point, my SAR request returned nothing from RBS, although out of five loans I had paperwork for four of them, although I didn't tell them that, my most current loan which I am still repaying they couldn't supply me with the paperwork, but they're still happy to take the long standing payment from me, but after reading Di's comments about going into the Branch, I phoned my branch and spoke to a lovely lady who after checking came back to me to say they have requested it to be sent from their file storage place, how hard was that, and i'm pretty sure when my claims go in(sent special delivery this afternoon) they'll start to find things, tempted to complain to ICO about it.
But your plan sounds very tempting!
Forgot to add, they sent me a schedule of the loan details including the loan account number enabling me to put a claim in for it.
Thanks to all the competition posters.
