    Hello,
I have a claim with Capital One which is dragging on.
They sent me a copy of the agreement, I did not tick the box for PPI, but they said I agreed to it during a phone call to activitate my card. I cannot remember doing this , so I wrote back to them stating I wanted evidence of the phone call and what was said.
They replied saying they cannot supply a transcript of the phone call but their staff follow certain guidelines etc and as far as they are concerned the complaint is closed
Working on yet another letter to them along the lines of if I did not tick the PPI box I obviously did not want it.

    Hi there,

How did you find out you had PPI with Capital One? I had a feeling I had PPI on my Capital One credit card. But when I got a copy of statements going back the last 6 years, my account was in default so didn't show me much really apart from by balance every month. I then requested a copy of my agreement and I hadn't ticked either the yes or no box for PPI. So it made me think maybe I didn't have PPI after all. But now i am thinking maybe I did, knowing what Capital One are like they probably would of just added it on. :(

Shall I just send the FOS questionnaire off and hope for the best? Because if I did have it they must of just added without my consent and if I didn't have it i'm sure they will be quick enough to let me know!!;)

Any advice would be great :)

Hi all - finally got my statements from Nat West re the credit card I had. They only sent them for the past 6 years but I originally opened this account on 28/11/2000 (if you have read my previous posts I didnt have to pay the standard £10 the girl just said she would sort it for me, which was very kind of her but I had had a messing around with them). The credit card was originally a Nat West Air Miles card but when Air Miles stopped being involved it just became an ordinay Air Miles card. If this is held up by Nat West and they decide to pay me out what they owe me (but the way my luck is going I somehow cant see them doing it, its just the way my luck seems to go) will they have to go back to 2000 or just to 2005 as this is just where the statements they have sent me go back to.

Natwest made me a "goodwill" offer on my NatWest cc which I have had since 2002. Despite correspondence and me producing the statements they wouldn't budge on the dates and would only refund the last 6 years. They wouldn't add the statutory 8% either. I accepted it as it wouldn't be that much money and the wait for FOS to deal with it is so lengthy. They probably realise that and know many wont take it any further.

    Good luck with your claim.

Well i've just got off the phone to Halifax Customer Services. They rang me after another email I had sent to the CEO of Lloyds. Funnily enough I managed to get the same lady who I spoke to last week! She didn't seem very happy that i'd sent another email so soon and said "I thought I had explained it all to you properly last time"! So I asked if they had begun to deal with complaints yet and she said no they are still waiting! She said that is all she can tell me for now. I did also ask about complaints dealt with by end August if they were put in before 6th May and she said they WILL TRY to have complaints dealt with by then and I did stress that mine should be dealt with sooner than then as they've been with Halifax 6 months so far! ;)
They need to get cracking!! Can't understand the hold up, they should of started dealing with these complaints weeks ago!

    Hello Boycey,
Must admit I had never noticed PPI on my statements. It was only when I put in claims for other cards I dug out some old Capital one statements and discovered I was paying it.
Do you have any old statements?
They are saying I agreed to it on a phone call but surely they must have sent me something to sign afterwards.
As they have no transcript of the phone call I'm not going to give up.

No don't give up Kay. So how can they prove you agreed to it if they had no transcript of the phone call! :(
No i'm afraid I shredded all my old statements years ago, never dreamt they would come in so handy now! Lol
Well i've just filled in the FOS questionnaire and i'm about to send it. I'm pretty sure I did have PPI on it. Well I will soon find out. :)
So how long has your complaint been with them?
Good luck, hopefully you will get some good news soon :D

I would give them a ring and ask where your card info is, you paid for this.

I put my complaint in on the 5th May expecting it to be straightforward.
Reading back what other posters feel about Capital one I don't think we should give up. I will be writing to them again this weekend and I'll keep you posted.
Good luck with your claim Bocey, someone has to get somewhere with this lot !

    Hi all

Just received my response back from Grattan regarding an old catalogue account I had with them from 1993.

They are unable to uphold my complaint with regard to PPI being charged on this account as the premiums was clearly shown on monthly statements sent to me and that all their policies were optional etc., etc.,

This seems to be one of their 'get out' excuses now - that the PPI was shown on monthly statements so I should have cancelled it then. I agree it was, but I think so many of us were taken in to believe it was part of the account, and we had no option not to have it. I was a housewife at the time and this insurance meant I could never claim on it and before they come back with another excuse regarding partners - my husband has been self employed since 1984 so again the insurance was useless to us.

I realise this is a complaint going back many years, but I feel so angry that they charged me for insurance just to make more money out of me.

They have also made it clear that the issues I raise fall outside of the jurisdiction of the FOS owing to the length of time your policy has been 'in force' - I think they mean closed. But am very tempted to send into the FOS anyway. What do you all think?
