    Hi all - finally got my statements from Nat West re the credit card I had. They only sent them for the past 6 years but I originally opened this account on 28/11/2000 (if you have read my previous posts I didnt have to pay the standard £10 the girl just said she would sort it for me, which was very kind of her but I had had a messing around with them). The credit card was originally a Nat West Air Miles card but when Air Miles stopped being involved it just became an ordinay Air Miles card. If this is held up by Nat West and they decide to pay me out what they owe me (but the way my luck is going I somehow cant see them doing it, its just the way my luck seems to go) will they have to go back to 2000 or just to 2005 as this is just where the statements they have sent me go back to.

    I am not sure how Nat West work, but hopefully if they still have data going back as far as when you first taken this out, or if you still have any, then you could provide them copies, and hopefully they will go that far back, I do hope so, fingers crossed.:)

    Can anyone help... just had a letter back from Egg re:my account information as per Consumer Credit act, and they have responded with 'as the account is now closed, we are under no obligation to comply with a copy of the executed agreementunder the CCA as we no longer have a contractual relationship ..... it goes on to say that they are no longer obliged and have returned my £1 cheque.... does this mean I can't get my information.... I cant remember whether I had PPI on this card.... Thanks Jo

    That is the problem, if the account is closed they are not obliged as they state to send the details, yet if you request a Subject Access Request (SAR) they MUST COMPLY with the Data Protection Act (DPA) and supply you with everything they hold on the account going back at least the last 6 years.
    However, for this request it costs £10 cheque or postal order, and they have 40 calendar days to comply.

    There is a SAR letter template below if you decide to want to request for this, tweak to your requirements if you want to.

    However, if you did find out you were paying PPI and mis sold, you can still make a reclaim without the need of any paperwork.
    You could also try ringing and asking them, see if they let you know over the phone.

    Hi all, I sent an sar request to Capital One 13/6/11, ( had a credit card with ppi, which is now paid off), has anyone had any success with Capital One?

    I missed a few days on the forum, and the number of posts...what a lot has been going on!!!

    With regard to Capital One...what a shady lot!! I asked someone over the phone if my account had PPI, and was told, NO! ( It does, but there seems to be a common thread of lying from banks to customers on that front..it suggests any tactics to keep us from reclaiming and in turn exposing their unethical, ( illegal?) tactics.:mad:

    I have two claims in with Capital One and would also appraciate hearing of any successes...

    On another note, scooting through all these posts, what a lot of information Di has provided..!!!:A If we were in favour of claims companies , Di, you should start one!:rotfl:

    Yes Capital One are a very shady lot and the best advice for anyone is NEVER EVER DEAL WITH CAPITAL ONE

    First post on this forum and looking for advice if I have any grounds for a claim.

    I previously took out a loan for £36k with First National (who later changed to GE Money) in 2004. Not long after taking out the loan I noticed that I was paying PPI and complained that I didnt ask for it.

    The company responded by sending me a copy of the signed agreement with the PPI box ticked, I never tick these boxes since I have a very secure job but thought at the time I didnt have a leg to stand on.

    Around 2005 my ex wife and I started divorce proceedings and I contacted GE Money as they had told me that all the PPI money was reclaimable (less an pro-rata sums) if the loan was paid off early. I was told I would be entitled to around £5500.

    The divorce took some time to complete (2 years) and when we finally got to settlement and I went to reclaim the monies owed, GE Money then stated that they would only repay 7% as it was outside the 36 month window, I argued that we were in the 36 month therefore I managed to get back around £1100 (20%).

    I guess my question is, was this acceptable and do I have any grounds for a reclaim for additional funds?

    The problem is I cant remember if we had it or not... is it worth just sending a letter demanding repayment of the PPI anyway... chnace my luck... or would you suggest the SAR route first?

    I have a claim with Capital One which is dragging on.
    They sent me a copy of the agreement, I did not tick the box for PPI, but they said I agreed to it during a phone call to activitate my card. I cannot remember doing this , so I wrote back to them stating I wanted evidence of the phone call and what was said.
    They replied saying they cannot supply a transcript of the phone call but their staff follow certain guidelines etc and as far as they are concerned the complaint is closed :mad:
    Working on yet another letter to them along the lines of if I did not tick the PPI box I obviously did not want it.

    If this was a loan and it shows no amount for ppi, then you did not have it, check the loan amount and monthly payments to see if the ppi is there but not shown as a seperate amount.

    If this was a credit card, then you may have had ppi added at a later date, that is why it is not showing on the agreement.

    advice please on PPI reclaiming. can i claim back PPI for the last 6 years, or from the inception of the account?? as they have more or less said that they were wrong, surely we can claim since the first time PPI was charged, no matter how far back???
