    thanks di
to be honest i havent been told anything by the FOS with regards to distress etc, its only because i spoke to a colleague of my adjudicator i found out about them backing my missell claim etc as i had been phoning and told no change from when i first contacted them , and that was in april . i havent recieved any letters e-mail etc since the adjudicator contacted me first about my case which was in september . I feel a little let down to be honest , i know that they have a massive caseload , but no contact in 7 months is a bit ridiculous especially when they have backed my claim , i thought they normally get in touch every 3 months .
    thanks
    dean

    Hi Dean

To what I know of it is that of 3 months, well in my own experience with the FOS anyway, so do contact them on regular intervals.
    Good luck.

This story hit the headlines in the USA press and TV.

    Bank of America Gets Foreclosed
Bank of America has little patience for homeowners who have fallen on hard times and behind on their mortgages. The lending giant is in the midst of foreclosure battles in every state as well as defending against allegations that they engaged in fraud and misrepresentation during the foreclosure process.

Given all the increased scrutiny you would think the bank would be extra diligent before pursuing homeowners in court. Think again.

First the mega-bank wrongfully foreclosed on a couple who had paid cash for their house (and thus not only did not have a mortgage with Bank of America but owned title to their property free and clear). Then, when the couple fought the mistaken foreclosure, Bank of America refused to back down, insisting they owned the home.

When Bank of America lost the foreclosure action they were ordered to pay the couple's attorney and court fees, since it was Bank of America's error that brought the action in the first place.

Instead of paying those fees promptly, Bank of America let the bill sit for over five months. Tired of banks getting away with actions that can throw an average citizen in jail these days, the couple and their attorney had a stroke of genius. They foreclosed upon the bank.

The action got the attention of the bank. After an hour of being locked out by bailiffs while their furniture, computers, and cash in the till was seized, the branch manager was able to get the couple and their attorney a check for the fees owed.

The actions of Bank of America says everything about the attitude permeating lending institutions in this country. They abuse customers and non-customers without so much as a second thought and ignore the rule of law at will. And while the "little guy" turned the tables here, you have to wonder just how many more stories like this are out there, only the homeowners were too scared, confused or just plain beat down to fight back.

Now, reading that must make your afternoon.:T:T:T:rotfl::j

doesnt it make your heart bleed eh lol

I know the fos are really busy at the mo, i've now been told it's going to be a while before the ombudsman looks at mine,i know they are inundated,As a matter of interest guys is there any evidence that the banks are upholding more cases now or are they still rejecting and sending a lot of cases via the fos
  • Hi again

I am really not doing very well with my claims. I have now had a further letter from Egg stating that even after 8 weeks they are still unable to resolve my complaint and if they cannot resolve it within the next 4 weeks they will write again! It is so frustrating I dont seem to be getting anywhere with any of my claims.

We have also had a letter back from Black Horse asking for more details on the loan, but we have given them all the details we hold, do you think sending off an SAR would help them find the details any better?

The same as above also with Direct Line asking for more details and asking for £10 if we send off more details.

Natwest still havent sent me any details as I was promised by them on 24/5/11.

The Co-operative bank (who were very helpful) sent off my claim to HBOS (who apparently our loan from AA was with and not Co-op as first thought) on 31/5/11 and still no word from HBOS.

Also I have a letter dated 6/6/11 from Barclaycard stating that they wrote to me on - wait for it - 23/6/2011 asking for more details!!!!

I am so fed up and with the terrible week (other bad things happening at home) I have had anyway I am starting to lose all hope and thinking of giving up but with my husband having to work a week a month without pay we could really do with some extra money at the moment.

    Hiya

I am so sorry to hear of your bad week and can just hope things will get better for you.

Seems like they are all stalling doesn't it?
And you did also email the CEO's of all the banks as well didn't you?

Someone I know who doesn't live far from me got so fed up, contacted the FSA and to her surprise the bank said they heard from the organisation and were sorry to hear of her issues, it seems they are now moving on with her case.

No I didnt e-mail them all, just the Co-operative bank. I dont have the e-mail addresses for the other banks. Could you also advise me which is the best letter/form to send off a SARs request.

    Thanks

    Hi hun

Yes there is an SAR letter template below you can use if you want to, and tweak to your requirements.
    https://forums.moneysavingexpert.com/discussion/1475553
And as you know, enclose £10 cheque or postal order, they have 40 calendar days to comply.

I shall get back with some email addresses for you.;)
