    Hi,

    In previous posts here, I said that I was charging the Banks concerned with FRAUD. Mis-selling of PPI's is fully covered by the Fraud act 2006

    RBS:
    The chairman CEO Stephen Hester of the RBS passed it down line and I got a letter saying "they could not proceed as I did not provide them with the correct information ?????
    THEY HAVE ALL THE INFORMATION plus numerous letters from me.
    FOB OFF AGAIN

    Letter back to Mr Hester asking HIM for more information about the information required ...... Also advising him that the RBS had committed fraud and probably on a mass scale.
    I advised him that I will persue my claim against the RBS for fraud.

    MNBA:
    Same letter ... no answer. This bunch provides credit cards for many high street retailers including Virgin.

    CAPITAL ONE:
    Same letter ... no answer. They have already been fined a huge amount for mis-selling but that did not stop them

    FRAUD FOR ALL 3, plus of course all the other banks involved in this huge money making scam.

    Interesting to read past posts here, the banks are still up to their usual lark of fobbing people off ... are the FSA and FOS going to crack down on them for doing this because as I see it, the banks don't understand:-

    This story hit the headlines in the USA press and TV.

    Bank of America Gets Foreclosed
    Bank of America has little patience for homeowners who have fallen on hard times and behind on their mortgages. The lending giant is in the midst of foreclosure battles in every state as well as defending against allegations that they engaged in fraud and misrepresentation during the foreclosure process.

    Given all the increased scrutiny you would think the bank would be extra diligent before pursuing homeowners in court. Think again.

    First the mega-bank wrongfully foreclosed on a couple who had paid cash for their house (and thus not only did not have a mortgage with Bank of America but owned title to their property free and clear). Then, when the couple fought the mistaken foreclosure, Bank of America refused to back down, insisting they owned the home.

    When Bank of America lost the foreclosure action they were ordered to pay the couple's attorney and court fees, since it was Bank of America's error that brought the action in the first place.

    Instead of paying those fees promptly, Bank of America let the bill sit for over five months. Tired of banks getting away with actions that can throw an average citizen in jail these days, the couple and their attorney had a stroke of genius. They foreclosed upon the bank.

    The action got the attention of the bank. After an hour of being locked out by bailiffs while their furniture, computers, and cash in the till was seized, the branch manager was able to get the couple and their attorney a check for the fees owed.

    The actions of Bank of America says everything about the attitude permeating lending institutions in this country. They abuse customers and non-customers without so much as a second thought and ignore the rule of law at will. And while the "little guy" turned the tables here, you have to wonder just how many more stories like this are out there, only the homeowners were too scared, confused or just plain beat down to fight back.

  • From RBS yesterday after I emailed several times and then chased up Mr Mclennan

    Dear Mr ******,

    Thank your for e-mail. I am sorry for the short delay, although I will be in a position to respond to your complaint no later than Monday 13 June 2011.

    So Monday could be D-Day...... I have asked for several things including whether their inability to make a sensible response to the ajudicators decision could now be reviewed and i potentially recalled from Ombudsman. They hid behind JR.

    Reckon will probably get an apology for delay and then usual speil regarding backlog and working exceptionally hard to deal with claims and they will aim to contact me before the Haleys Comet passes around again.

    I've just talked myself out of a decision on Monday Ho-hum.

    Suppose the lottery could come in.....

    Hi any advice will be gratefully recieved
    I have a PPI claim ongoing since a year last april with HSBC . Although i had a pre existing medical problem , full sick cover with work , and the actual form had the box with i dont want ppi ticked , but then crossed out and ppi wanted ticked ( as bank manager wouldnt give me the loan without the ppi ) the bank wouldnt admit to a miss sell . The claim has since been with the FOS since last july , and in dec my adjudicator found that i had been missold , but HSBC disagreed with the adjudicator aswell .Since then my claim has been with the FOS checking dept before it goes to the ombudsmann . Has anyone else gone through this route and how long does it normally take to go through checking and then to the ombudsmann . My adjudicator has told me she has no idea how long this will take .

    Hi Dean

    Yes many have been as far as the ombudsman.

    What will happen now is that the ombudsman will review your complaint and any info from the bank, your reasons will be taken into consideration.
    They do mostly agree with the adjudicators decision in most cases that are moved on to them.
    Did they also mention further redress for distress and inconvenience?

    Its difficult to predict a timescale of when your case will be moved to the ombudsman but you should not be waiting as long as you did when you waited for your case to be seen by an Adjudicator.
    However, contact them monthly for an update.

    to be honest i havent been told anything by the FOS with regards to distress etc, its only because i spoke to a colleague of my adjudicator i found out about them backing my missell claim etc as i had been phoning and told no change from when i first contacted them , and that was in april . i havent recieved any letters e-mail etc since the adjudicator contacted me first about my case which was in september . I feel a little let down to be honest , i know that they have a massive caseload , but no contact in 7 months is a bit ridiculous especially when they have backed my claim , i thought they normally get in touch every 3 months .

    Mr Mclennan is the "fall guy" for Stephen Hester. He passes it down the line so expect a "fob off" letter from someone else. If that does happen, bounce it all the way back to the top and that is Stephen Hester.

    If you are right, do not take NO for an answer, demand an answer from Mr HESTER

    Do not be afraid to keep hitting at the CEO's of these dreadful banks, if everyone went straight to the CEO, THINGS MIGHT CHANGE.

    We must always remember the previous CEO of the RBS, Fred Goodwin, who led the bank into financial crisis and loss and, created the massive problem in the UK that we still suffer with. We must also remember that 70% of the RBS is owned by us. Therefore, Mr Hester has a responsibility as the current CEO to placate his shareholders.
    Currently, the RBS suffers from bad publicity and and the man in the ultimate position to sort it out is Mr Hester. Rest assured that the major shareholders of the RBS will be monitoring this as much as we do
