    Hi All,

Would the fact that we have previously gone bankrupt ( discharged 2009 ) affect our ability to claim PPI on our credit cards, loans ? All but two of our cards were included in the bankruptcy estate and had outstanding balances but over the years we had paid them off and run up totals again a few times over 10 years.

All of the unsecured/secured loans that had PPI attached ( about 5/6 in total ) had been paid off before we went bankrupt.

    Thanks.

    Hello there

Hope things have settled down for you now or hopefully soon, good luck.

I understand your still able to make a reclaim on PPI, but not sure how it affects the situation in regards of bankruptcy, but sure someone will know.
However, what you could do is post on the thread (bankruptcy) I am aware that others on there have made reclaims, and ask this question in regards of your ppi on there and what happens once successful, then of course please feel free to come back and ask for further help if required.

    Thread here.

also more details on how to reclaim here.

    Good luck.

Hello Di, Thanks for all your help in the past - I was wondering if you think this may be a 'delaying' tactic on behalf of Welcome Finance.
I put in a claim for PPI about 6 weeks ago, they acknowledged it and then wrote to me asking me to send my original passport or driving licence to verify identification. I sent my Driving Licence and received it back from them 4 days later saying they were processing my claim. This was 3 weeks ago. I then received a letter this morning asking me to send my original Driving Licence , not a copy, which I have already done plus the counterfeit. I rang them and they said they should have asked for the counterfeit before. This of course is delaying things even further. Interested to know what you think.

As I understood Welcome Finance are in default

What is happening with Welcome and the FSCS?

On 2 March 2011 the FSCS declared WFSL in default. This is because the firm is unable, or likely to be unable, to pay claims against it in relation to PPI. WFSL sold a substantial number of PPI policies to its customers, and a declaration of default opens the way for those customers, and any others who might have valid claims against the firm that are protected by the FSCS, to make a claim.
The FSCS will now be responsible for PPI claims against WFSL. To assist in its handling of claims, the FSCS has arranged to use WFSL's claims handling resources. However, the FSCS will remain responsible for all decisions on claims, which will be made in accordance with FSCS rules, and will closely oversee and monitor all steps in the handling of claims. This arrangement will enable claims to be processed more quickly and efficiently

Do you still make a complaint to them then or to the FSCS?

This is from the FSCS website

How to make a claim for compensation

The FSCS will be making arrangements to contact all policyholders who were sold PPI by WFSL on or after 14 January 2005, and will work as quickly as possible to process any claims received.
If you do not want to wait for an application form to be sent to you, you should contact WFSL’s customer services team on 0845 373 0386 or write to them at Welcome Finance, P O Box 10950, Sandringham House, Harlow, CM20 9JF. Alternatively, you can contact the FSCS customer services team on 0800 678 1100 or 0207 741 4100 to ask for an application form to be sent to you to make a claim for compensation.
If you have previously submitted a complaint to WFSL relating to a PPI policy that was sold to you on or after 14 January 2005, and you are awaiting a response, you do not need to do anything more. We will send you an application form.

What should I do if I have claims relating to PPI sold by the firm both before 14 January 2005 and on or after 14 January 2005?

If your claim relates to a policy sold before 14 January 2005, you should contact the firm directly and it will process your claim. If you also have a claim relating to a policy sold by the firm on or after 14 January 2005, the FSCS will send you an application form for you to make a claim.

If I remember corrrectly with mine, they did send a claim form in the post, I did take a look on the FSCS website just now but not came across it at the moment, so maybe you could just give them a quick ring and ask them to send you one by email attachment perhaps, or email them which may just take a little longer to get back to you though, tell them you did ring earlier today and was told to complete form via their website but unable to find it, so please could you send me one to my email address.

    I'm baffled now......:o
