I rang M&S again today and was told that the agreement they sent me (with the account number I didn't recognise and was different to the Credit Card number) was all they had on file for me so would appear to cover my dealings with M&S from original Storecard in 1994 to replacement with Mastercard (and it's eventual closure in Sept 2010).
As the copy they sent me doesn't have the box ticked for PPI I can only assume that when they issued me with a Mastercard in Oct 2003 to replace the Storecard it must have been by post and the PPI added on the basis that If I didn't opt-out then by default I had opted in. I believe there was story in the newspapers at the time highlighting M&S's approach in moving people from Storecard to Mastercard.
I realise I could be clutching at straws but on this basis might I have a case for claiming I was missold as if I didn't think I needed PPI for 9 years on a Storecard why would I ask for it on the Mastercard? My employment status with the terms and conditions haven't changed (I've been with the same employer for 29 years with good sickness and redundancy benefits).
If I feel I have a case on these terms, would I be best completing the template questionnaire and sending it to M&S with a copy of the agreement they sent to me as supporting information?
One final question - I keep reading on the forum about organisations having to have been covered by the FSA or GISC(?) at the time of the original agreement or does that no longer apply following the judicial review decision?

The rules still apply, but people have won mis sell with credit cards from the 90s, i dont remember any saying they were refused because they were not covered by the FSA/GISC.
When you put the claim in i would put your Mastercard account number too, so they know it is an updated card.0 -

They asked me for proof that i was paying for PPi on my credit card with them, sent back a credit card statement to them with proof that i was paying PPi,received letter from them yesterday saying they are now looking into my claim.
The cards were payed off in 2005
Lioyds said they could not find my credit card details on the system at first so thats why they said they needed proof
I think they were playing games with me at first.

My brother in law was having the same problem, they did try telling him he never had any PPI, he has dylexia and I checked the details for him, where PPI was found!
Apparently something else I know was told the same and another over the road on another site, yet it came out in the end.

I am wondering now how far can you go back with the PPi claims
Just been up in the attic with the cobwebs and the spiders wasnt a very pretty sight i can tell you, think its time i should have a clear out.
I found two original loan contracts from LLoyds one dated 1994 and the other dated 1996 what do you think should i claim on these or is it to far back.
Looking at the agreement there are four tick boxes within a box at the bottom of the agreement page the boxes have yes and no by the optional loan repayment protection section both yes boxes have been pre filled in with an X. Looks like the banks have been doing it for a very long time.
So should i go for it or what0 -

Hi there
This may vary from one bank to another.
It could be the case that if there are no arrears, you can request they refund the award directly to you.
Otherwise if any outstanding arrears its normally awarded towards that, and anything remaining plus interest is usually awarded directly to you.
But as said it may differ, as they may try to still refund the amount towards an account even if not in arrears, you could request for this back yourself though and try if you want to, good luck.The one and only "Dizzy Di"0
