    Hi folks

    New user here who has recently registered complaints with HBOS and HFC regarding potential missold PPI.

    I made both complaints by telephone and have had confirmation through the post that both complaints have been registered, HBOS simply sending a letter of acknowledgement and HFC asking me to complete a questionaire. Being new to this site I am wondering if completing the FOS questionaire in each case might have improved my chances of a successful claim but we shall see what happens there.

    My story is as follows;

    I have had two loans with HBOS dating back to December 2000. I requested copies of both agreements recently and upon receipt my hunch that I had PPI on both loans was confirmed. The first loan I took out in December 2000 I have no recollection of how the PPI was sold, what information I was given and how I agreed to it. So my complaint with regards to this is I was not given any information with regards to the PPI and it was not explained that I did not require to take the insurance out. I think I have a good case with that one. It was taken out over the phone and repaid in full before the end of its term.

    The second loan in February 2006 is a much larger one but I am not sure I am going to be so successful with it. On the loan agreement I can see I have ticked a box and signed my name to take out the PPI with the loan. Again however I have no recollection of this being explained to me and my argument with this one is that I was not aware that I did not need to insurance to be accepted on the loan. The application was done online and the loan was repaid before the end of its term by refinacing with HBOS but with NO PPI this time! I firmly remember being put through to someone to discuss PPI and rejecting it. I cannot remember this happening with the prior two loans.

    I am also complaining about PPI on a credit card from HBOS which I took out in 2004. The PPI is based on the balance on the card which I have built up twice and paid off in the years I have had it. The card is now used to pay for work expenses and cleared off every month. I actually cancelled the PPI two months ago. With this one I cannot remember being asked about PPI and was quite annoyed when I realised how much it was costing me.

    The HFC PPI is the one, albeit smaller than the above, that I am adamant I was missold. In fact the whole loan was missold to me in a very sneaky and underhand manner although it could be argued I am gullable!:D HFC I assume got my name and number from a finance agreement taken out on a computer. They kept phoning me from their Edinburgh branch asking me to come in to discuss my finances. So I agreed and went along and when I told them what debts I had they suggested a loan with them which I stupidly agreed to. I found the person I dealt with more of a salesman who clearly was getting commission for pushing out loans. Again with this one PPI was added and I have no idea how it was sold (taken out December 2003) and what information I was given. I was constantly pestered by these people in the years passed for further meetings, obviously to try and get me to take out more loans. I really want get my money back from these guys.

    Having worked out how much PPI I have paid on these loans and using a simple interest calculator at 8% I could be due back somewhere in the region of £5,000 to £10,000.

    My questions for the very helpful people on this forum are;

    1) Would my case have been more concrete if I had used Martins forms provided by FOS and not phoned in my complaint? It seems the forms are very helpful and get good results.

    2) If my claims go unsuccessful should I go straight to the FOS and use the forms provided? How much would my chances be increased with this method?

    3) What are my chances of getting my money back on the second HBOS loan seeing as it looked as if I ticked the box and the form and signed my name? How could I argue this was still missold?

    Hello,

    I asked Marks and Spencer to send me a copy of my Credit Card agreement (I had a Mastercard, which was issued in Oct 2003 when the storecards were being phased out - paid off and closed in Sept 2010) but they sent me a copy of the Storecard agreement from October 1994 (on which the PPI box was definitely NOT ticked). I take it it was an oversight on their part as opposed to them not having anything to send me as I have read elsewhere that when they phased out the storecards they simply issued Mastercards to everyone to take their place. Is it worth me just contacting them again and asking them if they have any paperwork relevant to the Mastercard? I haven't gone down the road of a SAR as I want to wait and see what their paperwork says I did or didn't agree to.

    Sorry, in addition to the above, when I did the second HBOS loan application online I was not accepted online initally and had to phone a number to give further details. So this was a combination of online/telephone.

    Hi everyone :)

    Lloyds TSB asked for ppi proof on two of the claims that i am making against credit cards on monday of last week, received a letter from them yesterday

    Out of the six claims i have had two replys from Lloyds TSB cards and one Lloyds TSB loan.

    The Lloyds TSB letters i have received are standard letters that they are dealing with my complaints.

    I have also received a letter from Barclay card stating that they will contact me by June 8th.

    I only started the ball rolling two weeks ago on the above claims so quite happy with the response that i have had so far.

    Could anyone tell me if this is normal procedure and what do i expect next . I have tried looking back on the thread but the thread moves so fast that i find it hard keeping up, Sorry if this question has already been asked but i cant find anything on the thread and there are so many threads that i dont know what day it is :embarasse:D

    Hi there,are you sure there was ppi on the 2 cc that they are asking proof of ppi for? as it seems odd to ask for proof of this, i have not heard of this before.

    Do you have any statements that show any ppi?.

    You could give them a ring and ask for this agreement.

    Is the account number the same for both cards?.
    The one dated 1994 could be the agreement that covers from the date you opened the card to the date you settled,unless you signed a new agreement when the card changed to mastercard.
    I could be wrong but that is what it looks like to me.

    The cards accounts have been closed in 2005

    Lloyds didn't have any data records for them so they said.so they asked me to provide proof that i was paying for PPI.
    I did this by sending them a copy of the credit card statement
    They then sent me a letter back saying that they are dealing with my claim.

    Your case would have the same strenghth, as you would have had the same reasons for mis sell.
    2) If my claims go unsuccessful should I go straight to the FOS and use the forms provided? How much would my chances be increased with this method?
    If they respond with a "no take it to fos" then that is what you do. If you get a "we dont believe we mis sold this policy" then post the reply on here and we will help you with a follow up letter.
    3) What are my chances of getting my money back on the second HBOS loan seeing as it looked as if I ticked the box and the form and signed my name? How could I argue this was still missold?
    Not sure about the chances with this, but others on here have ticked the box and won mis sell, i suppose it depends on the reasons you have for mis sell
    Any help much appreciated!!
