After attempting to reclaim PPI a few years ago I was fobbed off by Alliance & Leicester, with this new ruling I'd like to bring my complaint up again and would also like to do a SAR request to pull up all of the old information on past loans.
The thing is now my current A&L loan has been taken over by Santander so who do I SAR? If it is Santandar then will I get the information going back 6 years to a previous A&L loan that has been paid off?0 -

I have been away for a while but I am very happy that the BBA lost and we own - hurray!!!. Di, I have a question for you, I had a loan with Abbey National which is now Santander although I defaulted when I was made redundant, I later in 2003 paid off the loan. When I recently requested for Consumer Credit Agreement 1974, they sent me a handwritten form which does not show any details of PPI, I kept requesting but they would not send me the Consumer Credit Agreement 1974, all they have done is a copy of part of the Agreement which has terms and conditions but not percentage, or how they calculated the monthly loan. They also claim that since the account is now closed and does not have money outstanding, they do not intend to deal with this case any more and that should I want to contact the FSO, I can do so within six months from the date of their letter. Di, what do you think?0 -

To claim mis sell the loans would either have to still be running or paid off within the last 6 years, even so, you could try a claim and see what they come back with.

Do you have both account numbers? if you do then if you have valid reasons for mis sell then put a claim in and save the £10 you will pay for a sar.

So when Santandar bought A&L they took over everything including past loans that had been previously settled before the takeover?

When you put a complaint in tell them you want them to look at the one you paid off with the one that is still running as well.
When you put your complaint into Santander they will deal with your mis sell.
I put mine in with A&L and every letter from then was from Santander0 -

Go for it, as long as you still have the account numbers that is fine, you do not actually need anything else as such.
Complete the reclaim questionnaire as on step 3 below, keep copies and send one to whoever sold you the account/head office or complaints dept, and allow 8 weeks, good luck.

ive had a letter back from hfc included in the envelope was a questionnair but not the usual one its a form that hfc have done themselfs i have 10 ten days to fill it in and send it back shall i send this form in or do you think i should do the official form printed from here?

Try this for complaints, but contact them to ask them for an address for data requests, good luck.

Did you do this by actually requesting for a Subject Access Request (SAR) to their data dept? they should hold details up until the last 6 years at least but its known when people have requested data by a forms of a SAR, as they must comply by the Data protection act (DPA) to send all they hold on you - or they must return the payment for this and a letter to explain.
If you haven't, there is more on SAR below, its a template letter, you can tweak to your requirements if you want to - but enclose £10 cheque or postal order, they have 40 calendar days to comply.

However, if as long as you have the account number of that account, you can normally continue to make a reclaim.
So if you still have hold of this, try for the reclaiming, see what they come back with then.
Step 3 - Reclaim questionnaire, complete and send to the ones who sold you the loan, keep copies and allow 8 weeks for a decision.

To track down account numbers, if you were paying the loan out of the same account now, and bank online, this sometimes allows you to go back 7 or more years, and its shown next to the loan monthly repayment.
