Hi guys, i wrote to you about 5 weeks ago telling you about my recent letter from the adjudicator at the f.o.s. the decision is looking good for us and as far as the adjudicator goes he gives us the thumbs up:j so the final decision is now with the ombudsman. You did tell me last time that normally his or her decision does normally go with the adjudicator and with a claim of approx £18000 i certainly hope so. anyway this morning we recieved an update from the f.o.s reading the following....
You may be aware from the press reports that in oct 2010 the BBA on behalf of a number of high street banks filed papers in the high court requesting a judicial review of the financial services and the f.o.s. it goes on to say that this is a legal challenge relating to reclaims of PPI being sold inappropriatly. it also says that it went ahead in court on the 24th january 2011 and is likely to go on for sometime. it says it is continuing with claims at this present time and could go on for a while as they are recieving 2500 claims per week !!!
My question is this, after battling for 7 months could it be all for nothing, is there anything i can do to speed up the payment process, also should i now cancel my policy (which ime still paying) just incase the courts once again go in the banks favour. Ime really worried now, i missed out on my bank charge reclaims and i dont want to miss out on this if i can help it. Once again guys thanks for everything youv'e done, your site is fantastic and what you do for everyone is amazing. keep up

And lets hope its sooner rather than later that we get a result, a good one for that matter.
And just a suggestion if you've not done so already, maybe you could try sending the Chief Executive Officer (CEO) of the bank a letter or email, see if that helps.
Although no guarantees it may still be worth trying.;)

My 2 are still sitting with Lloyds (my last 2 loan ppi), all the others I have been successful with over the last year, and due to the JR is the reason why no decisions have been made on these last 2 yet, however, I did chase them up by email the other day and was told that i should hear an update by or before 16 April.
I am wondering though - the reasons for not hearing any updates as such will may mean good news, or would they have rejected by now perhaps?

Received a letter from M&SMoney this morning as I had requested they continue investigating my case as the FSA had advised and not wait for JR results. They said:
The BBA have asked the Court to quash FSA policy statement "The Assessment and redress of PPI complaints" in its entirety and to quash online guidance on PPI complaints published by FOS in its entirety. BBA say 3 fundamental errors in law:
A breach of FSA's Principles does not give rise to a right of action in damages from a private person.
The Principles are relevant when assessing firms' liabilities to customers in respect of sales regulated by ICOB and ICOBS.
Firms can be required to pay compensation in cases where firms have no legal liability to customers.
They say that in light of this they consider each complaint received and assess whether it is affected by the JR. If not affected they will make a decision. However in my case they will not make an assessment or determination until JR decided.
Do I assume therefore that if the JR goes in favour of the BBA we will not be getting favourable outcomes on our complaints? So many legalistic phrases and words it is difficult to understand what they are really saying.0 -

I know what you mean, and it can be hard to follow.
Its a job to say, but to what I am aware of even though no formal decision will be made that soon, I did believe we would have some sort of update towards the end of March going into April, as seen on Lloyds Website I think it was.
So all we can really say and hope really that it does go in our favour and any complaints already made and ongoing should still be dealt with.;)The one and only "Dizzy Di"0 -

My MP Claire Perry has given her support to my case after 2 years of FOS bumbling around. She is writing to the Secretary to the Treasury, Mark Hoban MP as well as the Chairman RBS and the CEO of the FOS herself. Might just get things going a bit. FOS phoned last week to let me know our case is now a priority.....coincidence?

Well done. I hope we dont miss out on this one either. I have had my PPI claim in since Aug 2009:mad: Its with the adjudicator and so just waiting for the outcome. I also missed out on the bank charges too, I must have been asleep:rotfl::rotfl::rotfl:
