So i sent my letter off on the 15th and got a reply back today from first response
We acknowledge the complaint received on the 16/03/11 regarding a payment proctection policy purchased on 11/07/07 and are now in the process of investigating this.
Please be aware that should your complaint be upheld,then any refund will be calculated in accordance with financial ombudsman service guidlines on redress. This would mean that any arrears on your agreement would have to be deducted from the settlement of your claim and affect any refund payable to you .
We will write to you once we have completed our investigation0 -

Thanks for your reply but I think I should have made my question clearer.
Taking my oldest card (NatWest mastercard) I have been using this since around 1995, obviously I have had many issues of this card. The question then should be if I claim on the current issue of the card will they take into account any of the previous issues, where the account number would have presumably been different? (I'm assuming here that the account number changes each time a replacement card is issued)
I guess that given that they are only required to keep records for 6 years they would only need to look at 3 or 4 previous issues anyway.

I don't think they will take up any previous accounts to be honest, only that of what your complaining of.
Yes they are supposed to keep records for the last 6 years, but some will hold on to them longer, so if you requested a SAR (Subject Access request) they must send you all they still hold on the accounts, and if you have had a few accounts taken with the same business, one SAR covers all you have taken out with them.
Its been known that some have received documentation from a SAR request even beyond the 6 years.

Thought I must reply.
I have been very grateful for this website and the help it has given me. This is the first time I have seen the "helpful suggestions" as I thought the letter had been replaced with the FOS questionnaire, which is what I have sent off.
Let's face it, if the Banks do not think they have mis-sold us policies, for whatever reason, there is no way they are going to refund our PPI. So, if for any reason, anyone receives a refund, there must have been some doubt that the policy sold was fit for purpose.0 -

Well a bit of an update after I posted a month ago:
"...I did write to the FOS chief executive and CC'd (probably overkill) CEO RBS, CEO FSA, David Cameron, Claire Perry MP (My MP), The Times, The Daily Telegraph and Robert Peston. CEO RBS..."
My MP Claire Perry has given her support to my case after 2 years of FOS bumbling around. She is writing to the Secretary to the Treasury, Mark Hoban MP as well as the Chairman RBS and the CEO of the FOS herself. Might just get things going a bit. FOS phoned last week to let me know our case is now a priority.....coincidence?

Hi guys, i wrote to you about 5 weeks ago telling you about my recent letter from the adjudicator at the f.o.s. the decision is looking good for us and as far as the adjudicator goes he gives us the thumbs up:j so the final decision is now with the ombudsman. You did tell me last time that normally his or her decision does normally go with the adjudicator and with a claim of approx £18000 i certainly hope so. anyway this morning we recieved an update from the f.o.s reading the following....
You may be aware from the press reports that in oct 2010 the BBA on behalf of a number of high street banks filed papers in the high court requesting a judicial review of the financial services and the f.o.s. it goes on to say that this is a legal challenge relating to reclaims of PPI being sold inappropriatly. it also says that it went ahead in court on the 24th january 2011 and is likely to go on for sometime. it says it is continuing with claims at this present time and could go on for a while as they are recieving 2500 claims per week !!!
My question is this, after battling for 7 months could it be all for nothing, is there anything i can do to speed up the payment process, also should i now cancel my policy (which ime still paying) just incase the courts once again go in the banks favour. Ime really worried now, i missed out on my bank charge reclaims and i dont want to miss out on this if i can help it. Once again guys thanks for everything youv'e done, your site is fantastic and what you do for everyone is amazing. keep up
