  • Hi All, I was talking to my colleagues today about an incident that happend in 2005 and one of the ladies suggested coming onto this site for advice.

    I had taken out an Egg loan a few years earlier and then in 2004 (i think) i re-financed to consolidate some items. I know that i'd always had PPI and the loans were always completed over the telephone. Anyhow in 2005 i had a particularly bad family bereavement which left me unable to work. I took a couple of payment holidays and as i was still being paid carried on paying my loan but by August 2005 lost my job and could no longer afford the payments. I applied for the PPI insurance and waited. When my next payment was due i called Egg as i was worried about missing a payment and the gentleman on the phone told me not to worry, that everything would be sorted and i finished the call feeling much much better. That was on the Friday - on the following Tuesday i got a letter from Egg stating that they would not pay out on PPI as depression was not covered. I had previously had a short bout of stress years earlier and no one asked me about my medical history when re-financing my loan.

    After many phone calls i had to finally make the choice to declare myself bankrupt as i could no longer pay any bills. This basically sent me further into a spiral of deperession which i am still taking medication for today. I didn't work for more than 2 years and now can still only cope with part time work.

    Could i claim the PPI payments back? I do have the account number for the loan but no paperwork as the Insolvency service took all of my paperwork.

    Your advice would be gratefully recieved and sorry for rambling :o

    Hi and welcome

    Yes go for it, it seems you have good reasons to make a reclaim, and sorry to hear of all your issues as well.

    You pursue the ones who set up your account/who sold it to you, for just having the account number that is fine, a few of mine I onnly had the account numbers and that was ok.

    Complete the reclaim questionnaire on link below - stage one of reclaiming, keep copies of all you send and receive in case you need to go back to it at some point, they have 8 weeks to make a decision, they may ask for more time but should keep you informed.
    Make it clear to them you tried making a claim and it was unsuccessful because of your medical conditions, and also tell them if you were aware of this when the loan was sold to you then you would not have opted to take the policy out, as its worthless to you.

    I got a very odd letter from the FOS yesterday. They sent me two pages of why they were sorry it has taken so long for my case to be seen....judicial review outcome.....etc, etc.... And sent me a cheque for £100 for the inconvienience!

    Not sure how to deal with that, its not the FOS who I have the complaint about (although they have been particularly slow recently, but £100!, that's weird...). In this time of osterity, not sure the FOS should be handing out cheques, it is after all yet more tax payers money.

    Any comments?

    Wow, that is something new with the cheques, but yet I understand they have been sending out letters of apologies and updates to people due to the waiting.
    So does the cheque actually state its from the FOS?

    To save going all the way back on posts, did the FOS maybe the ombudsman uphold this in your favour, and offer the £100 inconvenience payment anyway, so when this is finally paid out the bank would just have to pay out what they owe without the inconvenience payment perhaps?
    Maybe this would therefore have to be reimbursed from the bank to the FOS.
    Just a thought but I'm possibly wrong.
