PPI Reclaiming Discussion part 4

I have started to write my letters and forms to hopefully claim back my PPI. If anybody can help me out I would appriciate it.
I have a loan with Northern Rock for which I have filled in the form from these forums, this is not the problem. I have also found documents relating to 2 different loans with the Abbey from 2003 and 2004 and also documents to a credit agreement for First National which I think is now part of Santander from 2002.
Firstly can I claim on thses as I have the documentation and secondly if i can claim do i just send a letter or fill in one of the consumer questionaire forms
The other one that my wife has is still ongoing with Santander which is a store card, She never asked for the protection to be included. Should she cancel the protection and then raise the claim.
Thanks hopefully0 -

Hi there
First of all good luck on all your reclaiming.
Yes you can make a reclaim with the reasons you have for being mis sold, even if you just had the account number with no paperwork that is fine.
You can complete the reclaiming questionnaire or write a letter, or you could complete the questionnaire and write a cover letter if you need to give further information.
Your wife can also cancel at any time and make a reclaim to Santander's address.
Please keep us posted and good luck.;)The one and only "Dizzy Di"0 -
hiya, thanks for your response. Sorry I probably didn't explain properly. I got the usual letter when I lodged my complaint saying they would look into it etc...I then got a letter at the 8 week stage saying that the matter was on hold until after the JR review. I decided to hold off going to the FOS until after the review simply because i've heard they're struggling due to the sheer volume of complaints so I thought it may be quicker to leave it with RBS. After carpy's success though I will be writing a first class letter tomorrow. What annoys me more is that it took from June - Sept 2010 to get copies of my original loan paperwork and if RBS hadn't have stalled and delayed so much this matter would most probably have been settled by now!0

Hi everyone,
Just heard back from the FOS today, Lloyds TSB have so far failed to respond to the adjudicators decision in my favour. As a result my case has now been passed to the Ombudsman, does anyone know what the current waiting period to hear back is?
Thanks for all your help.0 -

Hiya
Hope your well.
Typical of Lloyds this.
However normally your not waiting as long as you may have when your case first went to the FOS, but with the volume of complaints getting higher with the FOS it can be difficult to predict a timescale.
I would contact your adjudicator on a monthly basis at least and ask for an update.
Good luck and hope your not waiting much longer.;)The one and only "Dizzy Di"0 -
I have received 2 letters from Barclays this morning covering 2 loans, one taken in 2004 and one in 2008. Both are identical template letters saying they have investigated but will not give a final decision until after JR results.
From this I take it they are not saying I have no case for mis-selling and they say I can take my case to FOS.
The loan in 2008 post dates the ICOB guidelines - should they not at least consider this case?
I know that the FOS will have a very long waiting list of cases to review so am minded to wait. I am not sure quite what the banks are aiming to achieve with the JR but obviously do not want to deal with PPI cases. If following the JR finding and the lenders do not find in my favour can I still take the case to FOS or have I "missed the boat"?0 -
Hi there, send this to fos now then you are in the "queue". Barclays may deal with the 2008 loan and if they do it is a bonus.Even if you send this to fos barclays will deal with this anyway after the review, so you will not be wasting anymore time either way.0

Thanks that is very helpful. I assumed it was "either/or" and once sent to FOS it would not be dealt with by the lender.0 -
Hi
I have received a letter from Santander stating that I agreed to PPI on my Debenhams account during a telephone converstation that took place in 1998; I therefore wrote back requesting a recording of the telephone conversation. They have now replied stating that they can confirm the policy was set up after a telephone conversation took place however they cannot provide a copy of the recording due to the amount of time that has elasped they no longer have it.
What I fail to understand is how can they say that I agreed if they have not been able to listen to the conversation.
They have said that this is their final response but I can take it to the Finance & Leasing Association.
I would be very grateful if anyone could offer any further advice on this.
Thanks in advance0 -

Hiya
