PPI Reclaiming Discussion part 4

  • I am in the process of trying to claim back PPI on some loans and credit cards. I had gone through the paperwork in the loft and written to all those I had old statements for.
    One of my cards had been a Beneficial Bank Visa card. I used the address on the statement and quite quickly had a reply from HFC Bank saying the account was transferred to MBNA on 7th September 2008 and as the complaint relates to a period before the transfer it was up to them to respond.

    Evidently I took the policy on 9th November 1989 and I requested PPI during the application. However they have offered me a full refund (plus interest) of all PPI paid during the past 6 years of £352.77.

    I am very pleased with this but wondered if I could ask them to reconsider as the card was used very little, if at all, over the past few years, and most of its use was in the previous period. If I request that they reconsider, can they withdraw the offer altogether?

    And well done!.:beer:

    Did they actually confirm if they upheld in your favour or if they gave an offer?

    If they uphold they should therefore refund all you have paid in PPI plus interest etc.
    You could ask them for a breakdown as well, maybe this will show what you paid in to the account of PPI.
    With an offer it could be anything they think is reasonable.

    Sometimes they give an opportunity for them to reconsider, if they did not confirm it was the final decision.
    In the final decision they enclose or they should enclose details of the Financial Ombudsman service (FOS).
    You can see if anyone else posts up with suggestions first if you want to, the best of luck.

    Excellent! Just as I suspected. As you were consolidating debt there was a need for flexibility in relation to the ppi, and as they advised the policy for you (as it was central trust I am assuming this is the case) they should not have recommended a policy that did not offer a pro rata rebate. This will be a straight up uphold at the ombudsman service provided that this was a recommended sale. Would you like me to write a paragraph and personal email it to you? Can you remember them recommending the policy for you? What was the loan term and how much was the ppi for? Cheers

    yes it was central trust that set up loan and PPI.would be very grateful if you could email me a paragraph to put in my letter regarding this issue.loan term is 15yr and paid £4,110.00 upfront for PPI which was added to loan.

    I'm after some advice. I sent PPI questionnaires on 8th December for 2 Black Horse loans and a Halifax loan. Received a reply from all of them fairly quickly saying they are looking into my complaints and will deal with them as quickly and simply as possible. Well 8 weeks passed and I still hadn't heard anymore. So I sent them all another letter at the beginning of this week saying I hadn't heard anything. Well I received letters from Black Horse today saying:

    "We aim to resolve your query through our internal complaints process as quickly as possible. However, the rules which determine how we assess your complaint are currently being considered by the Court as part of legal proceedings between the British Banker' Association, the Financial Services Authority and the Financial Ombudsman Service. This means that unfortunately we are unable to respond to your complaint at the moment.

    The BBA is working to ensure these matters are resolved as soon as possible. Once that is done, we will make a final decision and respond to your complaint as quickly as possible."

    What do I do now? One of my complaints I can go to the FOS as it was sold to me after 14th January 2005. But the other one says I can refer my concerns to the Finance and Leasing Association, as my complaint is not eligible for consideration by the FOS as they are only able to consider complaints regarding policies that were sold by Black Horse between 1st December 2001 and 31st March 2003 and from 14th January 2005. I took out the other loan May 2003.

    I'm still to hear from Halifax.

    Any advice would be great.

    A lot are in the same situation as you, I have 2 held back at the moment because of the Judicial Review, where the decision is yet to be made since the court case the other week.
    I am going to sit this out a bit longer. However mine is via Lloyds TSB.

    You could contact the FLA see if they can help, I did read that someone did have success through these about a weeks ago, and think but not certain its the same bank as yours too, so give them a ring, if they are unable to help, you can still ask the FOS for advice on your best direction to take.

    I am aware the FLA cannot help with lots of cases but give it a go, see what they say, you may be ok.

  • this January i made my final payment on my Egg personal loan which started in december 2002. the amount of crdit was £11565.00 and they added £1590.77 PPI and my monthly payments were set at £215.39 PM . Around january 09 i questioned them about the PPI as i hadn't requested this and according to my annual Egg loan statement for the period Dec 08 - Dec 09 which showed an outstanding balance of -£4855.61 on the 3rd feb 09 -£24.51 payment cancellation appears on the statement. then on the 16th of March 09 there is an entry on the statement of -£1590.77 payment protection cancellation, -£747.24 int paid debit adj and then -£747.24 payment protection cancellation. my further monthly payments were amended to £105 per month and the closing balance as of Dec 09 was -£1309.02. My payments have remained at £105 PM and as i said ealier i made my last payment in january 2011. now not being a mathamatician, with the adjustments made to my loan in March 09 am i owed any money back from Egg for the payments made towards the PPI

    I would give it a go with your reasons. It seems they added this without your knowledge, therefore many would assume it was all part of the credit and it shouldn't be, so there is no harm in trying to make a reclaim if you believe you have reason to.

    I am no mathematician either unfortunately lol, but if you do want anything worked out there are helpful folks on here that will check them out for you if required.

    To make a reclaim, its just a matter or completing the reclaiming questionnaire here stage one.

    Please note the above questionnaire replaced the template letter and was issued by the Financial ombudsman service (FOS) for the purpose of reclaiming.
    You send the completed questionnaire to the ones who set up the account, so if they have a head office or complaints dept send to them.

    Remember to keep copies of everything as well, in case you need to refer back to this again at some point.
    They have 8 weeks, but may write to ask for more time and give you a rough timescale of when you should hear of a decision.
