    Hi and welcome and well done on your success via Black Horse, hope your not waiting too long for your refund.

    It is correct that whoever set up the policy is the ones you pursue, so if Fords set this up, its them you write to.
    If you've a copy of the complaint you originally sent to make a reclaim, then forward this on to Fords finance head office, again though you will have to wait 8 weeks, but I don't think this one would be held within the Judicial Review, just mostly banks.

    So send them a letter alongside with a copy of your original complaint, and a copy of the letter you recieved from the business (copies are suggested and not the originals).
    If you no longer have the copy of the reclaiming complaint you sent, then write another and ask they refund what you have paid in PPI, plus interest, give your reasons and ask they get back to you by 8 weeks.

    Keep at them, good luck and please let us know how you get on, cheers.;)

    A belated happy new year to you.
    Haven’t spoken for a while so I thought I would give you a quick update.
    As you know I have been contesting the way in which Lloyds TSB paid my credit card PPI redress after the FOS found in my favour. They had the exact figures from August 2007 back to Jan 2000 but from Jan 2000 back to October 1987 they used a one month figure for the 13 years which I contested was unfair.
    The FOS has enquired on my behalf and still awaits the calculation method from Lloyds despite numerous requests for it.
    In the meantime I have written a further 3 letters (23 now in total) to Lloyds TSB customer care and also Eric Daniels expressing my disgust at the way I am being treated and the fact that, although Eric Daniels leaves in April, he is leaving a very disgruntled legacy behind him. Lloyds customer care have twice told me that they stand by their decision and I have asked them to provide me with the calculation method they used so that I can provide it to the courts as I am not prepared to let them get away with it.
    I received a phone call from the FOS over Xmas to tell me that Lloyds have still not provided the requested calculation breakdown but, they are increasing my payment by an additional £12,135.47 but they have not provided a breakdown of how they arrived at this figure.
    If this is the case then it proves I have been right all along and that Lloyds have treated me unjustly and unfairly and also raises the question as to whether they are still trying to sell me short. They originally paid me £18,892.57 last August, after 3 years fighting them and this additional amount will take my total redress to £31,028.04.
    I still have an ongoing complaint with them regarding the way in which they used my first payment to clear my credit card debt with them and I will keep you updated as to what happens.
    All I can say to anyone on here is don’t give up and don’t take no for an answer.
    I am now into my 4th year since I began my complaint and I hope it is not too long before the door is finally closed on my case and I walk away with everything that it rightfully mine.

    Hi i was told by the FOS that i wouldnt be able to put the claim in myself as i had already been through a claims company and i may be breaking the contract . At the end of the day if we get anything back it will be a bonus but im not holding my breath .

    Arh right I see.

    I take it though if the claims company will not go this direction, then you would be free to do this yourself?

  • Hi guys,

    In October 2010, i issued two seperate complaints to Natwest with regards to two loans and the missold PPI. Complaint 1 was ppi up to 2003 and Complaint 2 was ppi up to 2008.

    During the 1st week of December 2010, i received a formal response offering a goodwill gesture settlement of £1538. They also stated that they couldnt find out specific information out about my particular case, but they understood my concerns and as a goodwill gesture offered a payment of £1538. for charges up to 2003.

    In the acceptance form they provide, they make reference to the fact that if i sign and return the offer, that concludes and closes any other claims that i may have against the bank.

    I am concerned that if i sign and return this form, my complaint 2 will be closed.

    WOuld it be possible to write back to the bank and on a without prejudice basis, make a counter offer for complaint 1 and 2.

    Should i proceed with a counter offer and they do not agree, can i still accept their original offer or does that become void?

    Any help would be appreciated.

    Hi there southbeach, i would give them a ring first and ask what is happening with loan 2, they may very well be in the process of refunding loan 2. What ever they say to you concerning this, ask for confirmation in writing.I would not sign for loan 1 refund until loan 2 was also concluded, as you will not be able to go after loan 2 in the future. This could be (as they can find no paperwork) payout for both, if it is, then you either accept this or try to get the 2 loans looked at again, i take it you had no agreement numbers or paperwork?.

    I' m back asking for some advice again. I have been helping my daughter put in a claim for ppi refund on an Evans card. When she first got it it was with GE money then Santander. She contacted Santander and they told her to contact Genworth Financial. They have now written back saying that although they are the underwriters of this policy they did not origionally sell it and cannot comment on the sales process and that she should contact the distributor. Who should we contact now, as we are at a bit of a loss as to our next step. If anyone has had similar dealings with these companys any help would be very welcome. Thanks

    Hi there is this is in regards of a mis sold policy, its normally the ones who sold the account, so if this was set up by EVANS then it is them that are responsible for this if they have a head office then pursue them.

    However, if I were you contact the Financial ombudsman service (FOS) who will check who is responsible to be on the safe side, and explain the situation here, you can also ask if they will write to them on your daughter's behalf, this way you should not be fobbed off.

    hi guys!

    just a quick update...

    well, I had the letter from the Halifax, stating that the 8 weeks was up, and they are not in a position to give a final ruling on my case. they did not give any indication of a time-scale, just "that they will try to deal with it a.s.a.p" ...yeah right! :p

    So, I'm in the process of complaining to the FOS. Sending the letter, forms and everything tomorrow. wish me luck!
