    I would give it a go with your reasons anyway.

    May I also ask if you know how long the insurance ran for?
    Was it the one where it only runs for 5 years?

    For example, many have taken out loans, and the loans may have been on a 10 year term, but the insurance only protects for 5 of those years, yet after the 5 years the insurance runs out, but its still payable for the life of the loan.
    These are frowned upon and a complaint in itself.

    But yes do give it a go.
    If you require any paperwork on your loan, you can request a Subject Access Request (SAR) this is optional, sometimes some useful info comes back which may help your complaint, but not always.
    For a SAR they have 40 calendar days to send all the hold on the account, this should also hold details of how the loan was sold to you, if by telephone that may also be useful, you could always request for the copy of the phone recordings as well.
    The SAR letter I believe includes this request.

    However, for a SAR you enclose £10 cheque or postal order, and there is a letter template for this on the below link, tweak it to your requirements if you want to.
    Remember this is optional (SAR), but maybe useful if anything is enclosed to help your case, but I would still continue to make a reclaim with your reasons you have.

    Just an update on my progress.

    After sending my complaint regarding my mis-sold PPI via the phone banking and a letter on the 30 December 2010, using the templete provided by this site. I have just received a letter from Barclays apologising I was unhappy and they are looking into my issues.

    I take it they have 8 weeks from this point to come back with a solution??

    its 8 weeks from when you sent in your complaint, not from when they acknowledge it
    I'm proud to say that the banks no longer take money from me after becoming debt free

  • Hi im new to this and im just looking for advice. I went through a company called claims financial to try and reclaim the ppi that we were mis sold by southern pacific personal loans which i now believe is trading as britannia mortgages and loans in february 2005. We first put the claim in in june 2010 then in october we received a letter saying britannia had not seen fit to act reasonably in our case and we were advised to take it to the FOS which we did .We have now received an email from claims financial saying the FOS have rejected our claim as the business was not covered by their jurisdiction at the time of the sale.
    Can anyone give us any advise on any other route we can take ???

    Hi and welcome

    Many have been in the same situation as yourself, i am one of them, however i did not use a claims company though.

    I would ring the FOS anyway here:

    Explain your situation, even though they not able to help in regards of the company who were not regulated, they may suggest another avenue to you like they have with myself and others.

    Its going the direction of the insurer/underwriter, the lender and not the broker will send you the policy details on request, its normally a booket with the details of the insurer.
    Claims companies are not likely to deal with this one though, but its been as stated suggested by the FOS as another avenue to take.

    Mine is still currently ongoing with the FOS and its likely to take some time, but at least it have been passed on to an adjudicator now.

    Give them a ring anyway and see what they say, good luck and please let us know, cheers.

  • Yes i would agree with taking this up direct with the FOS but be aware that due to a judicial review in respect to new guidelins set by the FSA, a large backlog of claims is stretching the FOS's resources.

    Let us know how you get on though as it would be interesting to hear and maybe we can advice you further.
  • Hi there, looking for advice regarding next step for PPI mis-sell, sent off letters to the bank in September, have been told that my case was being dealt with, then I was told in November the investigation was completed and was with someone who would make a decision within a week, then was told it had been put on hold until after the judicial review. Is it worth my while waiting until after the judicial review before contacting FOS? Or would It be better to proceed down that avenue now? Just seems like stalling tactics, I was under the impression that the FSA has told the banks they cannot put any claims on hold also...
