the purpose of the court case later this month is to determine wether or not there are grounds for a juditial review, i would wait until the end of the month and see what the outcome is before deciding what to do, because if you go the the FOS you will be waiting at least 1 year.I'm proud to say that the banks no longer take money from me after becoming debt free0 -

Many thanks for that advice, was just surprised the amount of times I was told different things by RBS, seemed to be making it up as they went along, when I was told I'd get a decision within a week in Nov. I thought everything was progressing well0 -
In Dec 2010 I sent off my consumer questionnaire to Capital One to claim back PPI payments for following reasons:-
1. Marked no PPI required on original postal application in April 2003, yet PPI added in August 2004.
2. When I noticed PPI payments being taken in Jan 2006 I phoned Cap One to cancel and was advised that I would not save the full PPI payments and was offered a % reduction for a period of time, which I took.
Cap One have since replied stating that I added PPI in April 2004 during a sales call, I have no recollection of this conversation, I had no follow up paperwork from Cap One re PPI and infact PPI payments were not taken until Aug 2004, surely PPI would have been added immediately!
They also state that they sell PPI on a non-advised basis so would not have to inform me that I could get PPI cover from an alternative supplier and that I would not need PPI cover due to being in full time employment with full sick pay benifits, yet their operative clearly advised me that I would be no better off if I cancelled.
They have given me 4 weeks to respond to their letter, can anybody please advise my next course of action.

Stand your ground and stay strong now and adamant!
Tell them you don't agree with their decision.
If they have these details to prove to you then they wouldn't mind sending you the evidence, but keep at them, if they still don't resolve this for you, move on to the FOS.

Hi i rang the FOS today and they suggested i ring the claims company to see if i could put a claim in with the insurance company .They have agreed for me to do this . I still have all the insurance documents including a form on how to make a complaint which mentions the FOS so im assuming they were regulated by them when we took out the insurance although the FOS did warn they may deny any knowledge of the way the brokers sold the insurance .0

Ok I've been claiming back PPI from Lloyds TSB for 2 loans I started with them. My last letter stated that I was aware and had been told by an employee with the bank that 1 person who sold me the PPi had been fired, reemployed and fired again for the same thing. The other has been moved to another area where they do not deal with the public and have had the same complant made against them already a number of times.
So I finally received a letter advsising my complaint was being investigated. Now I ahve received 2 letters offering me ex-gratia off starting "we will ensure that you are back to the same position you would have been in, had the sinle premium PPI not been included with your loan"
Ok sorry but what does this exactly mean? I can sign ands accept this offer but they are not able to advise how much this would be I need to sign the paper and send it back to them. Is this a good result?
Alos one letter mentions a rebate I received in July 2009, I do not recall or know of this refund. I bank online and check this and I did not receive a payment on the date they state in the letter.
I'm not sure what action to take now? Could anyone advise please.0 -

this is the normal process for Lloyds, so the calculation will be done correctly once they recieve your aceptance.
they can not calculate the 8% simple interest until they have a signed confirmation, they then work to this date.
it is normal for Lloyds to give a rebate when a loan with ppi is settled early, i would give them a ring and ask them for the amount and details of how and when it was refunded as you can't find anything, at least then you can check knowing when and where to look.
my refunds on earlier loans normally followed about weeks after the loans were settled.
in the meantime i would send back the acceptance,

hi some advice please??
i submitted 2 claims back in summer one with egg lending for misold ppi insurance and also other with tsb aka black horse finance. my case against egg has been upheld and is awaiting juditional review before compensation is calculated.
my second claim was for a motor car which i purchased from a ford dealer back in april 2005 i was told i needed the ppi to gain the finance on the car i followed same procedures using templates from this site but after the 8 week thing was told they do not take resposibilty for this misselling as they only provided the ppi and may of been misold by ford and they reckon they contacted ford to look into this, do this sound reasonable? not sure what my next move is also i finished this loan off early due to family bereavement would i quality for any rebate based on this? sorry for all the questions but im losing the will with tsb had problems with them on and off for over a decade.
