Reply to 14910 - I'm new to this,I'll get the hang of it eventually

Hi, I am in exactly the same position as you. The first letter I got back from C&G said that they had referred my complaint to Lloyds TSB insurance. I received a letter from them saying I didn't have any Insurance and they returned all of my paperwork. I then sent back to head office and asked them to have another look and provided them with the insurance documentation. They are currently looking into this. I'll let you know how I get on.

Hi all, I'm new to this so apologies if I seem a bit dim with my questions.
Firstly, I took a mortgage out with lloyds tsb in 2005 and was told that I needed to take out an insurance policy with them to cover the loan in the event that either myself or my, then, partner died. Then in 2008 we added another sum to the mortgage to get some jobs done on the house. Again, I was told that I needed to take out this insurance with them to cover the extra borrowing as well.
My question is this, am I now able to try to reclaim the costs of these policies back as I wasn't told that I could have got them elsewhere and that I was given the impression that if I didn't take them out that the mortgage would be refused?

    Hi and welcome

If you believe you were mis sold on the PPI, then give it a go with your reasons you have.
Its optional, even though of course its best to have protection but it should have been optional and you could have found your own, it did not have to be their own, so if they pressurised you and you want to make a reclaim, make sure you have adequate protection for the mortgage and give it a go, because then it would have to be cancelled as well after its resolved.
I would not cancel it out quite yet though, not until its resolved and that you have cover in place.

To make a reclaim, just complete the reclaiming questionnaire, this replaced the template letter on this site, send it to the head office of Lloyds if it was then that sold it to you.

Remember to keep copies of all you send and receive in case you need to refer to this again at some point.
They have 8 weeks to give a decision, but may ask for more time, they should keep you informed.

The reclaiming questionnaire you will find below link, as stage one of reclaiming, good luck and please keep us posted.

If you want other opinions on this before going any further, then please post on a separate thread below, maybe Dunstonh can help more on this one.;)

Thanks everso. The loan is active until Feb / March. It's my boyfriends issue & he has no idea whether he has PPI or not - highly suggestive of a missold PPI to me (Men:mad:...some men:D!) He has struggled hugely to pay this huge loan off & has paid an enormous amount of interest & charges along the way.

Will give it a go & keep you posted.

Your very welcome Wendy, and good luck.;)

I wrote, mid October 2010, to EGG (RBS) and requested a copy of my original credit card application as I believed I’d been miss sold the PPI, I believe it was a condition of ne having the card, this was about 4-5 years ago.

Egg replied saying I had signed out to it and wasn’t miss sold anything. Again I asked for a copy of our agreement, which they’ve still not sent.

Egg replied saying in accordance with the FSA rules they have 8 weeks in which to reply and they would use this time to investigate my claim and come back to me – they also advised that they would stop the PPI payment that month, which they did. There 8 weeks was up 24th Dec 2010, I wrote to them again on 6th Jan 2011 advising them their 8 weeks was up and enquired how the investigation was going.

Egg replied on the 7th Jan 2010 advising me that they hadn’t reached a decision and would require more time before them could come to a decision. They advised me that I could, if I so wish, refer the matter to the Insurance Ombudsman and enclosed a booklet. (until now all correspondence had been email, via my online Egg account)

The following day I received a letter the letter made reference to a case between the Banks and the Insurance Ombudsman (FSA) that took place back in March 2010, they went on to say the outcome of that case was undefined as to how compensation should be calculated and therefore EGG are not settling any claims until it is clear as to how compensation is calculated, once clear they will be in touch – again they advised me that I could, if I so wish, refer the matter to the Insurance Ombudsman and enclosed the same booklet. They also said I could stop paying the monthly IPP if I wanted too.

    I have two questions:-
1- Can anyone point me to where I can find the details of this case because while they make reference to it they fail to make a traceable reference
2- Should I sit tight and wait for the matter of compensation calculation to be resolved or should I go ahead and register my issue with the IO

    regards,

I received the same letter, but they stated that my complaint had been upheld (which means that they agree with me) and they are awaiting the findings of the Judicial review to clarify how my compensation should be calculated. I should find out on the 29th Jan after the JR takes place. I only have my statements with PPI deductions as I never signed any paperwork.

    I hope this helps.

Hi all, i fear i may have messed up on this PPI thing and just want a bit of advice.
My hubby has a CC with HSBC which he has had for about 8-10 years now and still has. According to him he can't recall being told anything about PPI when he got it. He had just come to the U.K for the first time from New Zealand and is prety clueless when it comes to these things anyway lol! so when the PPI thing first came about I used Martin's template letter and sent it off on his behalf. Now i can't quite remember the exact reason but it was rejected for something along the lines of ' you were aware of it at the time of application...' anyways as the PPI story was only just breaking I left it there and challenged it no further. This must have been a year or more ago.
However since then i have realised that my hubby was going through an umbrella company and im wondering whether this means he was self employed when it was taken out? He has literally paid out a fortune in these payments over the years grrr...
As you can imagine it was so long ago that it was taken out that things are a bit sketchy and all paperwork lost :o So now i don't know whether to try again starting with letter one or just forget it?
Have people had much success reclaiming from HSBC?
    Thanks in advance

    Hi there

I am not sure where you would stand in making another reclaim but you have nothing to lose by doing so, give it another go with the reasons you have and see what happens.

Normally the timescale to complain to the financial ombudsman service (FOS) is 6 months from the final decision letter, but if your hubby was not send the final decision where it mentioned the FOS, then go for it anyway.

Just complete the reclaiming questionnaire (please note this replaced the template letter) on this site, and send to HSBC head office or complaints dept if it were HSVC whom set this up in the first place.
    You will find this here;
    http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#reclaim
    On stage one of complaining.

Keep copies of all you send and receive in case you need to go back to this again, they have 8 weeks to give a decision, but may ask for more time.

There have been success to what I am aware of, hopefully someone will post up of their own experience of them, good luck.:)

:D Hi thanks, i do want to give it another try as it was only their usual brush off first response.
Do i need to ask for a copy of his agreement do you think and also do you know whether using an umberella company for work means you are classed as self employed? If it does i guess i will have much more of a leg to stand on as it were.
    Thanks again.

    Hi there

    Your welcome

You can request for a copy of the agreement if you want to, if the account is still active they should still hold these details.
Just write a simple letter and ask they provide you with a copy of the agreement by 12 days, and enclose £1 cheque or postal order for this request.
Remember to enclose you account number if you still have this, but otherwise give them as many details as possible, full name, all addresses you been under since the account opened, date of birth and so on, this will make it easier for them to track down the details.

Some covered self employment but others did not, this varied from one bank to the other, and you can at the same time request for a copy of the policy booklet, they should supply these free of charge on request.

I am really not sure on the umbrella company thing though, not sure if it makes any difference, unless someone else can clarify on this.;)

  • thanks Di
the insurance got cancelled last year when I sold the house and paid off the mortgage but that still means that they've had 5 years of payments from me.
Which of the lloyds tsb addresses would you recommend the forms get sent to?
