Thanks for your reply. I await in anticipation to see how yours goes, I just hope its a positive outcome. Today is the 29th, and have not received anything from AXA, so obviously they are dragging themselves because it's holiday season and so hopefully, I will get a response in January 2011 too.

The other day someone phoned me up saying they were from lloydstsb and that the claim i had made for my ppi repayment was successful and how did i want my money, into my bank account, cheque or cash, as i was trying to close my lloydstsb account down and had opened one in a different bank i said cheque, so was handed over to someone else who told me that i needed to pay tax on amount due at p.o to account in india before recieving cheque, is this correct ?0

I am considering claiming back PPI from an MBNA CC that was taken out through Abbey at the time however it has now gone over to MBNA as abbey is now Santander.
This CC was an online application, and was taken out approx 5years ago.
I don't have all the documentation nor the date that I was accepted for the CC.
My questions are:
Can I use a SAR in order to get the information I need to complete the questionaire?
Is it likely I will have any luck as it was an online application?

Unless it is coming from india and you have to pay the postage tax to get it to you from there?. This does not seem right at all. I know it has been a while since I last sent a reply to this forum, but my complaint with Egg has become complex and Egg have admitted mistakes on my loan. My complaint is now waiting for a FINAL REVIEW by the Ombudsman.
Since July 2010, all of the Adjudicators have missed SERIOUS offences by Egg and have not even done anything to my ORIGINAL complaint.
I am writng a quote from a letter I got from the FOS in November:
"Egg made related to your PPI refund. Egg has conceded the rebate of £ 2281.97 should never have been used to reduce the outstanding balance of your loan account and instead should have been paid to my IVA directly. Egg has confirmed it will now make this payment to your IVA to rectify its original error."
This is odd. I do not know if the PPI refund I got in October 2009 of £ 2020.01 is going to be taken off my loan or NOT as they said they would do so. This has not been discussed in my letter.
I am in an IVA because of Egg anyway.
Egg now OWES my Insolvent Practitoner £ 2281.97 in which £ 500 comes to me.
Another quote from the same letter :
"In the view of the way Egg has handled your complaint, it will not now increase the debt remaining o your loan account due to the fact that it will be making the rebate payment direct to my IVA. Ineffect, by correcting its earlier error, egg will both reduce the loan debt and also pay the samme amount to my IVA."
Can someone explain this in ENGLISH, because I don't.

I am going to write a second reply after this explaining a second point in which Egg has done something else which IS AGAINST the law and I also need help.

That does sound confusing!
I would give them a ring, think they may be open today can't remember, but tell them you find the letter confusing and ask if they could explain this to you.

I have another matter in which I do need help from you from this forum and I will also start another thread as well.
The thing is that Egg has ADDED an ACCRUED INTEREST amount of £ 384.72 to my loan AFTER my PPI refund of £ 2281.97 was taken off my loan between July 2008 & May 2010.
According to the FSA guidelines, this is NOT allowed.
I believe Egg have BREACHED the Insolvency Act 1986 by adding an amount to a debt or a loan while the debtor is in an IVA.
This is wat Egg explained to the FOS Adjudicator :
"Egg has explained that after an account is placed in non-accrual, if the account is subsequently sold on or outsourced for collection, then due to the amount of missed payments on the account (Prior being placed in non-accrual) an interest balance is calculated and added to the account (as it had never been charged and it should have been).
I do NOT agree with this quote at all.
An ACCRUED INTEREST IS AN ADDITIONAL CHARGE and IT IS ILLEGAL UNDER THE INSOVENCY ACT. They have also lied to the COURTS, my IP for NOT DECLARING THE FULL AMOUNT OF THE DEBTOR'S DEBT TO THE COURT AT THE START OF THE CREDITOR'S MEETING. They sold my account on to a third party in May 2010 with FALSE INFORMATION.
Do people agree with this and do you think I have a serious case against Egg.

I have had a Barclays Select acccount since 1999 and they have recently canceled the product. I only found this out when I tried to draw down on this account. They said letter were sent out but I never got one.
On investigation I see I have been paying PPI of £46 per month since the beginning of the policy. I did not even know I had a choice in the matter.
Do I have a right to claim this back?
over 11 years it seams quite a lot, is there a limit to how much banks would refund?0 -

I'm sure you can still try.
If they recently confirmed they sent a letter, as you did not originally receive it, ask that they send a copy, if they cannot provide it then they have not given any proof that they did actually sent you a letter (in my opinion anyway).
However, to make a reclaim, just complete the reclaiming questionnaire, this replaced the template letter, but you can still write a letter to reclaim in your own words if you want to, you can do either.

Send to the main head office of the bank, and keep copies of all you send and receive in case you need to refer to this at some point.
They normally have 8 weeks to give a decision, but please be aware there may be a hold up in regards of the Judicial Review, more on this on the FSA website here and on the links below on this site.

Thanks for the quick reply and happy new year.
I have already asked them to cancel the PPI payment, which they ageed was not nessasary and I have raise the issue of claiming back with the bank over the phone.
Would I need to send a letter as well or should I wait for a responce?
Also another anoying point is , I was sold health and life insurance from my select manager earlier in the year that covers all loans up to £50,000 for £17 per month.
Only because they canceled the product have i noticed the PPI, should my premier manager not have noticed this before selling me the new policy??0
