    hi everyone
    after getting letter saying no last week gave them a final chance sending them copies of my agreement but got letter this morning saying thats their final answer.i thought my claim would be no bother due to underlying health problems so phoned fos to take it futher as this is only my second complaint and i won first one just wanted to know what happens now i know it can take a long time now fos are involved anybody else lately been down same road with hfc?

    Hi there

    I understand many have had dealings with HFC.
    Anyway good luck with this and let the FOS continue now you've received the final decision.
    Yes it may take some time but with a bit of luck it will be straight forward and resolved in the early stages.

    Just thought I should mention though, if your in any hardship, do let them know and request for fast tracking, they may consider this for you.

    My DH put a claim in to the FOS in December 2008. He has been chasing it fairly regularly recently and finally we got an Adjudicator to start taking a look at the case. DH spoke to him last week and he said that Nationwide had sent a huge 400-page document for him to wade through, but that things looked quite positive for DH.

    I am unable to recommend that your complaint should be upheld. I am satisfied that Nationwide adequately explained that the policies were entirely optional.     Now, DH is obviously very unhappy. This is a true PPI case in that DH clearly remembers being forced to take the PPI - his Dad was with him during both phone calls and remembers DH getting upset about having to pay extra on top of the already high loan repayments. DH felt he didn't need it as he still lived at home and his Dad would help him out if any problems etc. Both times on the phone Nationwide said that he simply would not get the loan without the insurance.

    DH doesn't agree that just because it says 'optional' on the forms that he has signed then this must mean he was OK with it. Quite simply - he had already been told he had to have this PPI to get the loan - whether they stated it was optional or not.

    (on another note I myself had a successful PPI claim without going through the ombudsman last year and had equally signed a form that said the PPI was optional, but I signed it because I was told I had to in order to get the loan).

    Clearly DH is not happy and we assume the next step is to ask the Ombudsman himself to look at the case. They've asked us to supply any further evidence that may help - unless they'd take a 'witness statement' of sorts from DH's Dad I don't know what else we can provide.

    Has anybody had any experience of this? We feel so disappointed, as this was a definite case of PPI mis-selling that it looks as though Nationwide will be getting away with.

    Just a quick update, as promised, to say we wrote back to the Adjudicator and said we weren't happy with his conclusion and we described how upset DH was and how he is absolutely positive that he was mis-sold PPI and we wouldn't be complaining if this weren't the case. Gave a lot more detail about the conversations (that were witness by his father). Had a letter back yesterday from the Adjudicator to say he still doesn't see anything that will make him change his mind, so he's passing it on to an Ombudsman to review personally. We need to send in any evidence within the next few weeks.

    Now, is it worth us getting the SAR request in this case? Wouldn't the FOS already have this?? DH clearly remembers finally signing papers agreeing to it, as he'd been told he couldn't have the loan without it, but he doesn't recall exactly whether he completed that section or if they'd done it already. Would it make a difference if it had already been ticked/completed by Nationwide rather than DH anyway??

    Any ideas anybody?

    Other than that there really is no other evidence. I wish he'd recorded his own phone calls back then!

  • hi iv have sent the questionaire to lloyds and they wrote back stating they would get back to me within 4 weeks its now been 6 weeks since i recieved this letter what should i do?

    I am just starting to think that I may be eligible to reclaim PPI for two loans I have repaid to HBOS. My worry is that if I manage to reclaim the bank could close my accounts forcing me to find money to repay overdrafts and credit cards,
    Has anyone had experience of this, particularly with HBOS?

    Hi there, if the adjudicator rejected your decision, then as you know you do get the chance for it to be reviewed by the FOS, so its likely that actual adjudicator will not change the decision no matter what evidence you have put forward to them, but it will all go to the ombudsman for his own personal review of the ppi.
    So maybe he or she will see it in a different way perhaps.

    However, I do understand the bank will have forwarded details to the adjudicator in regards of your account, but I always requested for a SAR anyway in case they adjudicator wasn't forwarded the main bits that involved evidence for my complaint.
    Its up to you of course, whether or not they supply the FOS with a full SAR I am not quite certain on that.

    You do get a second chance with the ombudsman as annoying and frustrating this can be with all the waiting, fingers crossed he or she will see this in your favour, good luck and please keep us posted.;)

    One of my reasons added to mine was "please note, this is not my own tick and this was automated by the bank itself".

    They are actually entitled to 8 full weeks, but what you could do is contact them and ask them for an update, or even send them an email here below, remember to give your ref number details.

    Hi and welcome

    I have never had dealings with HBOS directly, but many have.

    They should treat customers fairly and have a lenders code to follow.
    Your reclaiming what is rightfully yours if you were mis sold the ppi for any reason.

    They should not try closing your accounts, but if your successful and you owe arrears on any outstanding accounts, they are able to refund towards them to what I am aware of, maybe someone will clarify on this, but as long as your uptodate I'm sure all will be okay.
