    I haven't had a loan from them in 2 years now...i paid all i owed back thank god! it was just getting to much having to pay all that interest on top!... I'll let you all know how i get on tomorrow some time...

    Thank you so much Di. Yes, the Adjudicator has sent it on to the Ombudsmen to look into now and did warn it would take longer. We're not bothered on the timescale to be honest - we'd just really like to see a fair result here as it was a definite case of mis-selling. I think DH is more upset that he's effectively being seen as a liar by the FOS because it is literally his word against Nationwide and they're obviously siding with Nationwide. I've told him to try not to take it personally.

    Unfortunately it's now been 7 years since he took the loan out. Do you think it's still worth sending the £10 and SAR off?

    I wish we'd done it at the start, but because we had all the details we needed for that first letter and we knew he'd been mis-sold we didn't see the point. Drat!

    Or will the FOS send me a copy if I ask them for it? I'm sorry for the questions.

    hi everyone.

    just looking for some advise on a ppi claim. the reason I'm looking for information is because my case is a little different.

    i understand that the best way to claim is to do it yourself but I'm unsure if i will need to use a claim company because of the case i have.

    basically i had a loan which my bank told me i needed to take ppi because it would increase the chance of being accepted for the loan. but after taking the loan i contacted the bank and told them i didn't want to ppi. they canceled it. NICE.

    but the option of canceling was to make me take out another loan without ppi to cover the cost of the loan which had ppi. resulting in me now having a loan without ppi but for a higher amount to cover the cost of the previous ppi.

    i want to sort the claim myself by sending of the letters on this web site but am unsure if they will work for me with this case.

    any help i greatly appreciated.

    I can understand how upsetting this must be though, as a genuine complaint and that is right to tell your hubby not to take it personally.
    (A thought have just come to me, why don't you ask your MP to write a letter on your behalf and send that in to the ombudsman);) its just a suggestion, but if you have a good local MP, this may be of some help for you perhaps.

    You could ask the FOS if they could send you copies of the details they have received and hopefully they will do this on request for you.

    In regards of asking for a SAR, this is totally up to you, it may be worthwhile or it may not be, its a chance to take, yet you may receive some useful documentation.

    I would definately have a go yourself, and hopefully if your successful you will get to keep all your money.
    The claims companies only do what we do on here anyway, and lots have had some bad experiences using them, with this site as you know its all free, the only thing you pay for is the cost of posting, where recorded delivery is suggested.

    What I would like to state is, this seems to be the banks policy/conditions if the ppi was cancelled after the cooling period, this can still vary from one bank to another though.

    But all you do is complete the reclaiming questionnaire on the link below, this replaced the template letter.
    Send to the head office of whom was responsible for setting this up from the start.
    Remember to keep copies of all you send and receive in case you need to refer to this at some point.

    They normally have 8 weeks to give a decision and they should keep you fully informed of the progress of your complaint.

    We have decided to send off the SAR request to see what we get back. It would be interesting to note if the PPI part was pre-completed, as DH can't recall exactly. He just remembers he knew he had to have it in order to get the loan. Obviously if it's been pre-completed or pre-ticked then it's a stronger case for us.

    We will write to the FOS in the meantime to let them know we'd rather they just waited a few weeks for us to get this information before they go any further. We were warned of a delay anyway, so I can't see this being a problem.

    I'll be sure to update you either way, although we are now fully prepared to be rejected. :(

    Hi there, you could put a claim in and say that you were mis sold the ppi on the first loan as you did not want it and you were told you wouldnt get the loan without it,you did not want this and you asked the bank to cancel the ppi and as a result of this you had to take a new loan without ppi.
    Your complaint would be that when you cancelled this ppi you were only told then that a new loan would be taken out.And you want a refund of the ppi rebate that was applied to the first loan and the new loan returned to the same apr and term as the first, as had you not been mis sold this first loan then you would not have a higher apr and monthly payment.

    Look here for other reasons you may have been mis sold.

    anyone claimed from aa loans? has been five weeks and out of the blue they have just sent me a statement of account and stated t and c to follow shortly, havent requested them so whats this about anyone any ideas?
