PPI Reclaiming Discussion part 4

Going back to my Hamilton (insurer) case, the problem I had was that the broker Click Finance dissolved and all other directions were taken, the FOS then looked into HFC as they were grouped with them, and wrote to them on my behalf, HFC then says all details of the insurance are those of Hamilton, where then it was suggested that I write to the Lender who was Endeavour Personal finance (EPF) for the Payment Protection Policy booklet.
I then had to forward a copy of this to the FOS and they then considered where to take this, and its been from one to the other, but the last year via Hamilton to date. The one and only "Dizzy Di"0 -
Hi and welcome
Its possible you may have a reclaim case here, but you can wait for other opinons on this first if you want to.
You should not have been pressurised into taking this out and should have had an option to choose your own protection.
So like loan ppi and a reason like yours it seems a likely case.
What you do to make a reclaim is, complete the reclaiming questionnaire, send it to the broker as he was the one who set up your policy, so therefore he is responsible.
Keep a copy for yourself as well, in case you need to refer to it at some point.
They have 8 weeks to give a decision but may request for more time, this is fine for as long as you know where you are.
The reclaiming questionnaire you will find here as stage one:
Good luck.
Thanks Di for the quick and helpful response.
I curse myself now for not being a bit more aware. I swear somebody ought to teach all this stuff at school!
I'm going to give it go. See if I can get my brain to cooperate with the FOS form this weekend. Nothing ventured, nothing gained after all.0 -

Regarding whether pursuing reclaiming against PPI when under debt management will cause trouble for your arrangements, I have contacted my debt management company and they say:
1) It will not rock the boat.
2) Do it yourself; which is exactly the advice given here.
3) Go to "moneysavingexpert.com" and get the details from there...
So time to do something about it.0 -
mumtothreegirls wrote: »HI any advice would be greatly appreciated. After looking at my A&L credit card statements I've discovered that I have PPI which I can't remember being sold. Just want to make sure I'm doing the process correctly. After reading some of these links am I right in assuming I don't need to get a copy of the T&Cs as I've been mis sold and I can go straight to a letter? I was going to completed the questionaire but have decided to do my own letter (after reading some of these posts felt that would be the best option). I've done a letter with the reasons why I think I've been mis sold ie didn't know and also noted in my letter that they (A&L) have recently been fined by the FSA for failing to treat customers fairly. I've also asked for a reply by 8 weeks and that if my outcome isn't satisfactory then I will be going to the FOS. Does this sound ok? Am I doing the right process? Don't want to muck my chances up.
Thanks in advance
Hi there
I had the same thing - I took out a credit card loan with A&L and I wrote to them, got no reply, then phoned them only to be told that MBNA should now deal with it, as they had taken over the credit card from A&L. It might be an idea for you to check your statements, as you may now find that MBNA are dealing with your account.
I did actually get a refund of PPI from MBNA, but they just deducted it from my credit card balance, rather than sending me a cheque, which is what I asked for. However, I have now taken my case to the FOS because my argument is that, had I not had to pay PPI on my credit card each month, the amounts I did pay, that went towards PPI (around £40-£50) would have reduced my outstanding balance further by that amount every month if PPI had not been included in the minimum payment expected, thereby reducing interest on my outstanding balance as well.
It might be worth bearing the above in mind when you write you letter, so that, hopefully, they will take that into account. I got an offer of a refund virtually straight away and they also said that they would enter into no further correspondence, but as I didn't not get the breakdown that I had asked for, I wrote back and asked for it, which caused further delays while the investigated my case. However, I got the breakdown and refund in the end - it's just a case of my wanting the outstanding balance reduced further because of the amount of monthly payments I made. I hope I'll get a cheque for any outstanding refund THIS time!
Anyway, good luck with your case!0 -

Great argument re the reduction of your balance if ppi wasnt included in the minimum payment.
I hadnt thought of that...will pursue that as well:beer:

Hi there,
Has anyone had any luck claiming against loans.co.uk? My partner and i took out a 15,000 loan back in 2005 with GE Money arranged by loans.co.uk, We think we was mis sold for several reasons and the main one being that the PPI was a one off premium paid upfront added to the loan making it 19,050! Well the PPI ended this year but we still have 5 years left on the loan so we are still paying for this PPI! Anyway have sent a covering letter and fos questionaire to loans.co.uk and GE Money just incase, Wish me luck.x0 -

Thanks Rockbird. My CC is now with MBNA!!! Do you think I would be better getting a breakdown of all PPI charged to my account first? I was planning on writing the letter (done but not posted) and also sending the complaint by secure email as I noticed that there is a function to do so when I log onto my account. TBH I would rather they deducted the amount from my CC balance to reduce it as much as possible but would have though it would be sent by cheque so that the onus would be on us to pay it into the account so that they were still getting there interest. I would just be scared to get the cheque and get carried away with myself!!!0
