    This bit can be very confusing Di. I would think that most people have pre existing medical conditions when taking out insurance but some insurers ask in their terms and conditions that you actually declare them. If you do and they come back with "you are not insured for that particular condition" then surely some would still want insurance for other conditions not relating to the previous one. If you do not declare them (and your terms and conditions ask that you do) who is to blame then?
    I wonder how they would treat that one?

  • Thanks Rockbird. My CC is now with MBNA!!! Do you think I would be better getting a breakdown of all PPI charged to my account first? I was planning on writing the letter (done but not posted) and also sending the complaint by secure email as I noticed that there is a function to do so when I log onto my account. TBH I would rather they deducted the amount from my CC balance to reduce it as much as possible but would have though it would be sent by cheque so that the onus would be on us to pay it into the account so that they were still getting there interest. I would just be scared to get the cheque and get carried away with myself!!!

    I refer to your letter dated 16 June 2010 regarding the mis-selling of Payment Protection Cover on my credit card.

    You state in the letter that ‘as a gesture of goodwill’ you have arranged for an immediate refund of £2058.88 into my credit card account.

    However, before I decide whether to refer my complaint to the FOS, I am writing to you to request – within 7 days – a detailed statement of the breakdown of the calculations including the resulting balance and interest owing.

    Furthermore, even though I cancelled the PPC on 14th May, I was told that I was required to give one month’s notice and, therefore, a payment was made for June. I would also like this payment refunded and taken into account in your calculations.

    I enclose a copy of a letter that I wrote to Alliance and Leicester on 7th May, requesting a fully comprehensive list of charges added to my account. I have not heard back from them and, on chasing them up this morning, was informed that my letter will have been passed on to MBNA. Please ensure that this enquiry is dealt with and that I receive the information requested forthwith, as the 40-day period is now at an end.

    Lastly, any refund, if accepted by me, should be paid to me by personal cheque and NOT refunded to my credit card account. I would like to decide where my money should go.

    I am writing to request a fully comprehensive list of all the insurance charges added to my account with Alliance and Leicester/MBNA. If you are unable to provide this data, I will accept copies of my statements. I understand that statements on their own are not covered by the Data Protection Act, yet I’m not requesting the statements per se, but the charges, which I’m entitled to.

    I look forward to your response within 40 days, as is obliged under the Data Protection Act 1998. If not I shall seek remedy from the Information Commissioner.

    As for getting a cheque, well it's probably not very likely, as I didn't, even though I requested one!

    I've just filled in the questionnare and made photocopies of letters I think are relevant...
    ...only problem now is that I'm not sure where to send it to!

    Do it send it to the original bank I opened accounts with, my local bank, or is there a Head Office address I should send it to?

    Any help would be amazing as I'd love to post it off tomorrow :o

    Hi there

    Good luck on your reclaiming.

    I would not post it to the branch but head office and post by recorded delivery, they will then pass on to the relevant dept for you.;)

    I am preparing myself for a battle with HSBC as I have found out that when my daughter was made redundant early 2010 she was told at the bank, in person, that she had to be out of work for 8 weeks before she could claim on her PPI policy...... I now believe she has been mis-sold this policy as I have read the whole paperwork for both the original loan and the PPI loan and NOWHERE does it say that if she was put out of work that she`d have to wait 8 weeks before being able to claim any payments on the loan through the policy and that they only state that A PERCENTAGE for refund of PPI on early settlement will be paid but nothing about what that percentage is going to be. I understand that the less there is left on the loan the smaller amount will be offered but as I first said 7.5 months on a 24 month loan left to pay is definately out of order.

    I would definately give it a go on the reclaiming then with those reasons.

    Whatever ppi have been paid into the account should be refunded, plus interest.

    Follow the link above which takes you to the reclaiming questionnaire to send to HSBC, keep a copy as well, they have 8 weeks to give a decision, but may possibly ask for more time.
    I think its best to post by recorded delivery as well for proor of delivery.
